not to exceed Three Million, Three Hundred Thousand Dollars ($3,300,000) to assist in the
<br />financing of the acquisition, renovation, and equipping of an office and warehouse facility
<br />Cthe "facility"), contining approximately 122,000 square feet of space and located at 1300
<br />Court Street, Portsmouth, Virginia, to be used by the Company in its business of importing
<br />and distributing goods, and has held a public hearing thereon on August 31, 1984; and

<br /> WHEREAS, the IDA has requested City Council to approve the
<br />comply with the applicable federal and state laws; and

<br />issuance of the bonds to

<br /> WHEREAS, a copy of IDA's resolution approving the issuance of the bonds, subject to
<br />the terms and conditions contained therein, and the appropriate certifications and documenta-
<br />tions have been provided to City Counail for their consideration.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the Council approves the issuance of Industrial Development Revenue Bonds by the
<br />Portsmouth Development Authority for the benefit of Collins Company, Ltd. to assist in the
<br />financing of the acquisition, renovation, and equipping of the facility to be located at
<br />1300 Court Street, Portsmouth, Virginia.

<br /> BE IT FURTHER RESOLVED that the approval of the issuance of the bonds as required by
<br />the applicable federal and state laws does not constitute an endorsement of the bonds,
<br />financial viability of the facility, or the credit worthiness of Collins Company, Ltd.,
<br />but as required by ~15.1-1380 of the Code of Virginia, 1950, as amended, the bonds shall
<br />provide that neither the Commonwealth of Virginia, the City of Portsmouth, nor IDA shall
<br />be obligated to pay the bonds or the interest thereon, or other costs incident thereto,
<br />except from the revenues and monies pledged therefor, and neither the faith or credit of
<br />the taxing power of the Commonwealth, the City, nor the IDA shall be pledged thereto.

<br /> "The Commissioner of the Revenue is requesting a refund of 1984 City Business License
<br />to Churchland Psychiatric Associates, 3800 Poplar Hill Road, Suite F, Chesapeake, VA 23321.

<br /> Drs. Lovko, Keitner and Chase trading as Churchland Psychiatric Associates moved to
<br />Chesapeake August 13, 1984. They paid $1,743.57 for their City Business License based on
<br />gross receipts of $25?,772.00, therefore, a refund of $1,162.37 (without penalty and interest)
