275 <br /> <br />O~tnh~r ~S, <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> That the City Attorney is hereby directed to institute eminent domain proceedings against <br />the owner of the following described property for the purpose of acquiring fee simple title <br />therein, together with any and all easements of access, light or air incident to the lands of <br />the owner abutting upon said property, in accordance with and pursuant to ~2.06, 2.07 and <br />2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, a! <br />amended) and to deposit to the credit of the Clerk of the Circuit Court of the City of Ports- <br />mouth as provided by law the sum hereinafter specified to compensate the owner of the land <br />described as follows, to-wit: <br /> <br /> All those certain lots, pieces or parcels of land, known, numbered and <br />designated as Lots 9, ll, 13, 15, ~17, 19, 21 and 23, Block 21, as shown on <br />that certain plat entitled "Plat of Virginia Realty And Investment Company", <br />recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, <br />Virginia, in Map Book 7, Pages 98, 99 and 100. <br /> <br /> The name of the property owner is: Johnny W. Everett and Eula Raye Everett, husband <br />wife. <br /> <br />and <br /> <br />The amount to be paid is: Eight <br /> <br /> Ayes: Beamer, Corprew, <br /> Nays: None <br /> <br />Thousand, Four Hundred Sixty-Six Dollars <br />Gray, Lucas, Webb, Whitlow, Holley <br /> <br />($8,466) ." <br /> <br /> 84-400 Letter from the City Manager recommending adoption of a resolution to authorize <br />City Manager to negotiate purchase of or institute eminent domain proceedings against Gust <br />Jones Realty Corporation in connection with the Midtown Drainage Project. <br /> <br /> See City Manager's letter under Item 84-399. <br /> <br /> On'mo~ion"of-'Mr. Gray and seconded by Mr. Beamer, the following resolution was adopted, <br />and by the following vote: <br /> <br /> 'A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY rHE CITY <br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS, PURSUANT TO CHAPTER <br /> 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR <br /> THE CONSTRUCTION, ALTERAFION, AND MAINTENANCE OF THE MID-CITY DRAINAGE PROJECT. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest herein- <br />after-described in and to the property hereinafter-described, situate in the City of Ports- <br />mouth, Virginia, for the purpose of constructing, altering, and maintaining the Mid-City <br />drainage project; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase the property necessary <br />the project because the presen~ owner of the property cannot be located; and <br /> <br /> WHEREAS, advancement of the work and use of said project will be delayed unreasonably <br />said property is not made available as soon as possible. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />tO <br /> <br />That the City Attorney be hereby directed to institute eminent domain proceedings against <br /> <br />the owner of the following described property for the purpose of acquiring fee simple title <br />therein, together with any and all easements of access, light, or air incident to the lands of <br />the landowner abutting upon said property, in accordance with and pursuant to ~§2.06, 2.07 and <br />2o08~6flthe.iCharter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, <br />as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of <br />Portsmouth as provided bylaw the sum hereinafter specified to compensate the owner of land <br />described as follows, to-wit: <br /> <br /> BEING the eastern one half of Lot 15, Block 32 on the plat of "Virginia Realty <br />and Investment Corporation", recorded in the Clerk's Office of the Circuit Court <br />of the City of Chesapeake, Virginia, in Map Book 7, Pages 98, 99 and 100. Said property <br />being more particularly described as follows: <br /> <br /> BEGINNING at the southwestern right-of-way intersection of Columbia Street and <br />Landcaster Street; thence along the southern right-of-way of Columbia Street south <br />88019'24, west, 168.47' to a point; thence along a curve to the right having a <br />radius of 3,844.83', an arc distance of 47.63' to the True Point of Beginning; <br />thence south lO40'36,, east 85.05' to a point; thence south 88°19'25,, west 15.00' <br />to a point; thence north 1940'36" west 76.72' to a point; thence along a curve <br />to the left having a radius of 3,844.83', an arc distance of 17.16' to the True <br />Point of Beginning. <br /> <br />The property owner is: Gus Jones Realty Corporation. <br /> <br />The amount to be paid is: One Hundred Ninety-Five Dollars ($195.00)." <br /> <br /> Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br /> Nays: None <br /> <br /> <br />
