<br /> WHEREAS, the application has been determined by the Planning Commission to have met
<br />the requirements of §40-55 of the Code of the City of Portsmouth, Virginia, 1973; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project
<br />pursuant to 540-55 grants only an exemption from certain requirements for residences as
<br />stated in said section, and does not constitute a waiver of any other requirement embodied
<br />in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia,
<br />or any other applicable local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the certain group housing project consisting of 8 condominium units to be constructed
<br />on a parcel of land consisting of 20,767 square feet at 321-335 Green Street, end designated
<br />as GHP-84-20, and more specifically described in correspondence from Gerald F. Martin,
<br />AIA, dated October 9, 1984, and shown on plans filed with the appropriate officials of the
<br />City of Portsmouth, Virginia, such being made a part hereof, is hereby granted approval
<br />subject to the following terms and conditions:

<br /> 1. A standard site improvement plan must be submitted for approval to the Engineering
<br />Technical Services Department showing the appropriate easements and existing utilities.
<br />
<br /> 2. The permanent easement for ingress and egress as shown on the plot entitled
<br />"Subdivision of Parcel 1 Northside Redevelopment Project Part 1 - Va. R-39", prepared
<br />for the Portsmouth Redevelopment & Housing Authority by R. Kenneth Weeks, dated June 7,
<br />1977, shall remain open for ingress and egress at all times.

<br />~40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT
<br />BEING KNOWN AS "RIVER EDGE" PHASE I, AND CONSISTING OF 60 CONDOMINIUM UNITS
<br />AND DESIGNATED AS GHP-84-22.

<br /> WHEREAS, Portsmouth Partners, by A. P. Ditteaux, General Partner, and Bush Construction
<br />Corporation, Managing General Partner, has made application pursuant to §40-55 of the Code
<br />of the City of Portsmouth, Virginia, 1973, for the granting and approval of a group housing
<br />project to be known as "River Edge"; and
<br />
<br /> WHEREAS, the application designated as GHP-84-22 includes Phase ~ of a ten (10) year
<br />project which will result in the construction of six hundred (600) condominium units, and
<br />Phase 1 includes s~xty (60) condominium units for the Detroit Street area of Wallace
<br />Circle; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met
<br />the requirements of 640-55 of the Code of the City of Portsmouth, Virginia, 1973; and

<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended conditional approval of said application; and

<br />pursuant to 540-85 grants only an exemption from certain requirements for residences as
<br />stated in said section, and does not constitute a waiver of any other requirement embodied

<br />known as "River Edge" Phase 1, to be constructed on an eight (8) acre parce~ and designated
<br />as GHP-84-22, and more specifically described in correspondence from A. P. Ditteaux, Director
<br />of Development for Bush Construction Corporation, dated October 10, 1984, and shown on ~lans
<br />filed with the appropriate officials of the City of Portsmouth, Virginia, such being made
<br />a part hereo£, is hereby granted approval subject to the following terms and conditions:

<br /> 1. Site and landscaping for Phase 1 must be submitted to the Planning Staff for
<br />review and approval prior to issuance of building permits.
<br />
<br /> 2. Utility relocation and design £or Phase 1 mus~ be submitted by the developer to
<br />the Department of Public Utilities for approval. Utility design for the remaining future
<br />development area must be submitted by the developer to the Public Utilities Department for
<br />approval.

<br /> 3. A standard site improvement plan for Phase 1 must be submitted for approval to
<br />the Engineering & Technical Services Department."
