<br /> 2. Dale F. Witt is hereby granted a use permit pursuant to ~40-71 (b) of the City Code
<br />to construct and operate a self-storage facility on the east side of Victory Boulevard north
<br />from its intersection with Greenwood Drive, such property more specifically described as Tax
<br />Plate 520, Parcel 1, such parcel contalnmng 7.69 acres.

<br />3. The use permit is approved subject to the following conditions:

<br /> (a) A landscaping plan must be submitted to and approved by the Planning Department
<br />and must include treatment for the eastern and southern borders of the property and internal
<br />landscaping to soften the visual impact of long rows of buildings and large paved surfaces.
<br />The plan must be approved by the Planning Department prior ~o issuance of a building permit."

<br /> WHEREAS, Philgrador D. Duke, by Curtis E. Jordan, has made application pursuant to
<br />940-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a
<br />permit to operate a child care center; and
<br />

<br /> WHEREAS, the applicant and the Planning Director have done all things required to be dom
<br />in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of a use permit for the
<br />operanion of a child care center.

<br />NOW, THEREFORE, BE IT RESOLVED by the Council ~f the City of Portsmouth, Virginia:

<br />1. That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />the neighborhood of the proposed use:
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or im-
<br />provements in the neighborhood; and
<br />
<br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code.

<br /> 2. Curtis E. Jordan is hereby granted a use permit pursuant to ~40-75 (b) of the City
<br />Code to operate a child care center at the property described as Tax Plate 205, Parcel 62, am
<br />designated as 2708 Bagley Street (UP-SS-i).
<br />
<br />3. This use permit is approved subject to the following conditions:
<br />
<br /> (a) All interior operations of this facility must be conducted between the hours of
<br />6:30 a. m. and 6:00 p. m..
<br />
<br /> (b) Ail outdoor play activities shall be conducted within a fenced play area and
<br />limited to the hours of 8:00 a. m. to 6:00 ~. m.. Fencing shall be installed to completely
<br />enclose the play area.
<br />
<br /> (c) The child care center may be operated with an enrollment of not more than twenty
<br />six [26) children to be cared for at the facility at any one time.
<br />
<br /> (d) Ail health, fire and building codes must be met prior to commencement of operatic
<br />of the facility.
<br />
<br /> (e) The applicant shall comply with all applicable codes, ordinances, policies and
<br />regulations of federal, state, and local governments, and shall obtain all necessary licenses
<br />and permits.
<br />
<br /> (f) The use permi~ is issued to Curtis E. Jordan for 2708 Bagley Street and is not
<br />transferrable to any other person, entity, or location.'
