<br />Beamer and seconded by Mrs. Webb, the following items approved on first
<br />Hearing and regular meeting of February 12, 1985, were adooted by the
<br />
<br />85-41 Rezoning, use permit and group housing applisations, and an amendment
<br /> to the City Code:
<br />
<br />(a) "ZONING AMENDMENT ORDINANCE Z 85-1"
<br />
<br />(c) "ZONING AMENDMENT ORDINANCE Z 85-3'

<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT
<br />TO [40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS
<br />AMENDED, SAID PROJECT BEING I2 CONDOMINIUM UNITS IN 3 BUILDINGS OF ~
<br />UNITS EACH CALLED NOTTOWAY CONDOMINIUMS TO BE LOCATED AT 3715-3721
<br />KING STREET.
<br />
<br /> WHEREAS, Richard P. Molenaar, James Wayland, and Michael Rowe, has made application
<br />pursuant to 240-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended, for
<br />granting and approval of a group housing project consisting of 12 condominium units in 3
<br />buildings of 4 units each to be located at 3715-3721 King Street; and
<br />

<br />WHEREAS, the application
<br />requirements of ~40-55 of
<br />
<br />has been determined by the Planning Commission to have met
<br />the Code of the City of Portsmouth, Virginia, 1973, as amended;
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plan submitted
<br />therewith and has recommended a conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuan
<br />to ~40-SS grants only an exemption from certain requirements for residences as stated in said
<br />section, and does not constitute a waiver of any other requirement embodied in the subdivision
<br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicable
<br />local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other recuired permit will b
<br />issued only upon compliance with the ordinances, laws or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that
<br />the cer4ain group housing project consisting of 12 condominium unmts in 3 buildings of d units
<br />each at 3715-3721 King Street and designated as GHP-85-1, and more specifically described in
<br />correspondence from Metro Development Corporation, Richard P. Molenaar, Vice President, dated
<br />December 5, 1984 and shown on plans designated "Nottoway Condominiums" and filed with the
<br />appropriate officials of the City of Portsmouth, Virginia, such being made a part hereof, is
<br />hereby granted approval subject to the following terms and conditions:
<br />
<br /> 1. A detailed landscape plan, including a walkway system from parking to entrances and
<br />screening the parking along the rear and side property lines, must be submitted to the Plan-
<br />ning Office for revmew and approval prior to issuance of building permits.
<br />
<br /> 2. A standard site ~mprovement plan must be submitted to the Department pf Engineering
<br />for review and approval."

<br />(e) "ZONING AMENDMENT ORDINANCE Z 85-5"
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO DALE F. WITT TO CONSTRUCT AND
<br />OPERATE A SELF-STORAGE FACILITY ON LAND ON THE EAST SIDE OF VICTORY
<br />BOULEVARD NORTH FROM ITS INTERSECTION WITH GREENWOOD DRIVE.
<br />
<br /> WHEREAS, Dale F. Witt, by SLH & Associates, contract purchaser, has made application
<br />pursuant to §40-71 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting
<br />of a use permit as hereinafter-described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and
<br />
<br />~HEREAS, the Planning ~Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working in
<br />the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or improve-
<br />ments in the neighborhood; and
<br />
