Attorney is in the process of its annual review of legislative actions taken by <br />the General Assembly of Virginia which mandates changes in the City Code. As a result of this <br />review, the City Attorney recommends that the following amendments to the City Coe be approved <br /> <br /> {al Due to certain changes in the State law pertaining to bingo games and raffles, <br />it is necessary to reordai~ and amend Section 21-54(a) ~b) of the City Code. These sections <br />incorporate the State law by reference and make them applicable ~o such activities conducted <br />mn the City of Portsmouth. The changes in the State law pertains to raffles of property in <br />excess of $100,000 in value and certaim provisions pertaining to application for bingo and <br />raffle permits. <br /> <br /> (b) The 1985 General Assembly adopted certain revisions to Title 5- of the Code of <br />Virginia pertaining to charitable solicitations. These new exemptions included certain museum <br />and health care organizations, and in addition, increased the dollar value for solicitations o~ <br />organizations before permit from the local governing body may be required from ~2,000 to $5,00~ <br />Tke attached ordinance will make the necessary changes in the City ~ode. <br /> <br /> (c) The 1985 General Assembly made several changes in the procurement law. These <br />changes which directly affect the City pertain to provisions for withdrawa~l of bids due to <br />error, services, procurement of sole source goods and services and emergency procurement. <br />The General Assembly also adopted prompt payment legislation which requires the City to make <br />payments of goods or services or the invoice date, whichever is later. The attached ordinance <br />reflects the changes necessary in the City Code. <br /> <br /> (d) Chapter 23 of the City Code pertains to motor vehicles and traffic, and recent <br />action by the General Assembly requires amendments to certain sections contained therein and <br />the attached ordinance makes the necessary changes to assure compliance with the State law. <br /> <br /> <br />
