<br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br /> 40-S5 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING
<br /> OF 152 RENTAL UNITS LOCATED ON THE WEST SIDE OF GEORGE WASHINGTON HIGHWAY BETWEEN
<br /> THE CORPCRATE CITY LIMITS AND NORPORT HOMES APARTMENTS AND DESIGNATED AS CNP-85--.
<br /> WHEREAS, the Hearring-Overton Partnership has made application pursuant to Section 40-55
<br />of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting and approx~l
<br />of a group housing project consisting of one hundred fifty-two (152) rental units on a 6.96
<br />acre parcel located on the west side of George Washington Highway between the corporate city
<br />limits and Norport Homes Apartments and designated as GHP-85-7; and
<br /> WHEREAS, the application filed by Ioseph Preziotti, Jr., has been determined by the Plann
<br />ina Commission to have met the requirements of Section 40-55 of the Code of the City of Ports-
<br />mouth, Virginia, 1973, as amended; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and made a recommendation on said application: and
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuan
<br />to Section 40-55 grants only an exemption from certain requirements for residences as stated
<br />in said section and does not constitute a waiver of any other requirement embodied in the
<br />Subdivision Ordinance, Zoning Ordinance, Ccde of the City of Portsmouth, Virginia, or any oth¢
<br />applicable local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br /> be issued only upon compliance with the ordinances, laws or regulations applicable thereto.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br /> the certain group housing project consisting of one hundred fifty-two (152) rental units on
<br /> a 6.96 acre parcel located on the west side of George Washington Highway between the corporate
<br /> city limits and Norport Homes Apartments and designated as GHP-SS-7, and more specifically
<br /> described in correspondence from Joseph Preziotti, Jr., Planning Consultant, dated March 5,
<br /> 1985, as shown on plans designated "Independence Square" filed with the appropriate officials
<br /> of the City of Portsmouth, Virginia, such correspondence and plans being made a part hereof,
<br /> is hereby granted approval subject to the follwing terms and conditions:
<br /> 1. The applicant shall reasonably satisfy the Fire Chief on the site design, building
<br /> placement, preventive measures to protect the future residents and the Frovision of adequate
<br /> access for emergency vehicles.
<br /> 2. ~en economically and legally feasible additional access to the site will be provide~
<br /> and the parking and access will be designed to accommodate such additional access in the futur
<br /> The access road to George Washington Highway will be improved in a manner acceptable to the
<br /> Department of Engineering and Technical Services.
<br /> 3. To the extent deemed appropriate, the recreational provmsions should be revised so
<br /> as to provide a p0ol, barbecue pits, herse shoes, or other adult recreational activities.
<br /> 4. A comprehensive landscape plan must be submitted to the Planning Department for
<br /> review and approval indicating general itc landscaFing, fencing along the railroad right-of-ws
<br /> and screening as required in Section 40-44 along that portion of the parcel abutting commercia
<br /> or industrial uses and the construction of internal sidewalks for pedestrian circulation to
<br /> the parking and recreation areas.
<br />
<br /> 5. A standard site improvement plan must be submitted to the Department of Engineering
<br /> and Technical Services for review and approval.
<br />
<br /> 6. Water mains must be looped to assure adequate fire protection.
<br /> 7. Sanitary sewer facilities and sewer Fump station would require up-grading at the
<br /> applicant's expense prior to the issuance of occuFancy permits and a standard site mmprove-
<br /> ment plan addressing the sanitary sewer provisions must be submitted to the Department of
<br /> Engineering and Technical Services for revmew and approval."

<br /> 8S-187 Councilwcman Lucas stated that on Tuesday, June 18, she had attended the meetin~
<br /> of the Small and Minority Business Enterprise Committee, and on June 20 received correspondem
<br /> from the City Manager announcing that our application for Planned Development Company for
<br /> small minority business had been approved. Mrs. Lucas inquired as to the purpose of the Small
<br /> and Minority Business Enterprise Committee and are there any incentives on the part of the
<br /> City to expand existing or to help new small minority and female~owned~bUsi~ess'es,
<br />
