July 9, 1985 On motion of Mrs. Webb and seconded by Mrs. Lucas, the following ordinance was approved on first reading by unanimous vote: "AN ORDINANCE TO APPROPRIATE $195,000. FROM THE PUBLIC UTILITY CAPITAL IMPROVEMENT FUND TO CONNECT TIDEWATER COMMUNITY COLLEGE'S SANITARY SEWER SYSTEM TO THE H~¥IPTON ROADS SANITATION DISTRICT PLANT." 85-195 - Letter from the City Manager recommending adoption of an ordinance to amend the Portsmcuth City Code by repealing Section 4-2 pertaining to animals and fowl. "Recent exposure of examples of cruelty to animals by uncrupulous fight prcmoters promp ed the General Assembly to make dog and cock fights a felony instead of a misdemeanor. Since the City can only parallel State misdemeanors in the local Code, it is now neces- sary that Section ~-2 of the City Code be repealed." On motion of Mr. Corprew and seconded by Mr. Gray, the following crdinance was adopted on first and final reading and by the following vote: 'AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, BY REPEALING SECTION 4-2 THEREOF PERTAINING TO ANIMALS AND FOWL." Ayes: Beamer, Corprew, Gray, Lucas, Nays: None 85-196 Letter from the City Manager recommending viewers for the closing of a portion of Powhatan Avenue. Webb, Whitlow, Holley adoption of a resolution to appoint State law to any inconvenienc "Darrell F. and Beverley,. Nuckles and David A. and Mary Ann Mitchell have made application to close a portion of Powhatan Avenue. The attached resolution appoints viewers in accordance with applicable view the portion of such street and to report to the Planning Commission is would result in closing that pcrtion of Powhatan Avenue. I, therefore, concur and recommend the adoption of the attached O~ motion of Mrs. Webb and seconded by Mrs. Lucas the Eollowing and by the following vote: resolution. resolution was "A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OR POWHATAN AVENUE. adopted WHEREAS, Darrell F. and Beverley G. Muckles and David A. and Mary Ann S. Mitchell, have made application to vacate, close, and discontinue the hereinafter-described portion of Powhatan Avenue, and it appearing that notice of application and request for the appoint- ment of viewers was duly advertised as required by law. NOW, THEREFORE, BE IT RESOLVED by the Council of the City oE Portsmouth, Virginia, that A. N. Kindrick, Simon P. Arrington, Richard D. Ottavio, James V. McGhee and Raymond Tweed be appointed viewers, and that R. E. B. Stewart and James Moss be appointed alternate viewers in The event one of the preceeding v~ewers fails to participate, said viewers to view the hereinafter-described port,on of such street and to report to this Council in writing whether in their opion any, and if any, what inconvenience would result in vacating and closing the following: POWHATAN AVENUE BEGINNING at a point on the eastern right of way of Powhatan Avenue, 64', more or less from the northeast intersection of Westmoreland Avenue with Powhatan Avenue and continuing in a northerly direction along the eastern right of way of Powhatan Avenue to the lower water mark of the Western Branch of the Elizaheth River; thence in a westerly direction along the low water mark of the Western Branch of the Elizabeth River to the western side of the right of way of Powhatan Avenue; and continu- ing thence in a southerly direction along the western right of way of Powhatan Avenue to a street light: and thence ~n a northerly ~irection and at right angles to the right of way of Powhatan Avenue across the right of way of Powhatan Avenue to the point of beginning. Said section of street to which ~losure is requested is adjacent to Parcel 380-0070 of tke Tax MaFs of the City oz Portsmouth. "Included in the 1984-89 Capital Improvements Plan ~s a project to fund the second phase of improvements to the Cit) 's Lake Kilby Water Plant.
