July 9, 1985 <br /> <br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the following ordinance was approved <br />on first reading by unanimous vote: <br /> "AN ORDINANCE TO APPROPRIATE $195,000. FROM THE PUBLIC UTILITY CAPITAL IMPROVEMENT <br /> FUND TO CONNECT TIDEWATER COMMUNITY COLLEGE'S SANITARY SEWER SYSTEM TO THE H~¥IPTON <br /> ROADS SANITATION DISTRICT PLANT." <br /> 85-195 - Letter from the City Manager recommending adoption of an ordinance to amend <br />the Portsmcuth City Code by repealing Section 4-2 pertaining to animals and fowl. <br /> "Recent exposure of examples of cruelty to animals by uncrupulous fight prcmoters promp <br />ed the General Assembly to make dog and cock fights a felony instead of a misdemeanor. <br /> Since the City can only parallel State misdemeanors in the local Code, it is now neces- <br />sary that Section ~-2 of the City Code be repealed." <br /> <br /> On motion of Mr. Corprew and seconded by Mr. Gray, the following crdinance was adopted <br />on first and final reading and by the following vote: <br /> 'AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, <br /> BY REPEALING SECTION 4-2 THEREOF PERTAINING TO ANIMALS AND FOWL." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, <br />Nays: None <br /> <br /> 85-196 Letter from the City Manager recommending <br />viewers for the closing of a portion of Powhatan Avenue. <br /> <br /> Webb, Whitlow, Holley <br /> <br />adoption of a resolution to appoint <br /> <br />State law to <br />any inconvenienc <br /> <br /> "Darrell F. and Beverley,. Nuckles and David A. and Mary Ann Mitchell have made <br />application to close a portion of Powhatan Avenue. <br /> <br /> The attached resolution appoints viewers in accordance with applicable <br />view the portion of such street and to report to the Planning Commission is <br />would result in closing that pcrtion of Powhatan Avenue. <br /> <br /> I, therefore, concur and recommend the adoption of the attached <br /> <br /> O~ motion of Mrs. Webb and seconded by Mrs. Lucas the Eollowing <br />and by the following vote: <br /> <br />resolution. <br />resolution was <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OR POWHATAN AVENUE. <br /> <br />adopted <br /> <br /> WHEREAS, Darrell F. and Beverley G. Muckles and David A. and Mary Ann S. Mitchell, <br />have made application to vacate, close, and discontinue the hereinafter-described portion <br />of Powhatan Avenue, and it appearing that notice of application and request for the appoint- <br />ment of viewers was duly advertised as required by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City oE Portsmouth, Virginia, that <br />A. N. Kindrick, Simon P. Arrington, Richard D. Ottavio, James V. McGhee and Raymond Tweed be <br />appointed viewers, and that R. E. B. Stewart and James Moss be appointed alternate viewers <br />in The event one of the preceeding v~ewers fails to participate, said viewers to view the <br />hereinafter-described port,on of such street and to report to this Council in writing <br />whether in their opion any, and if any, what inconvenience would result in vacating and <br />closing the following: <br /> <br />POWHATAN AVENUE <br /> <br /> BEGINNING at a point on the eastern right of way of Powhatan Avenue, <br />64', more or less from the northeast intersection of Westmoreland Avenue <br />with Powhatan Avenue and continuing in a northerly direction along the <br />eastern right of way of Powhatan Avenue to the lower water mark of the <br />Western Branch of the Elizaheth River; thence in a westerly direction <br />along the low water mark of the Western Branch of the Elizabeth River <br />to the western side of the right of way of Powhatan Avenue; and continu- <br />ing thence in a southerly direction along the western right of way of <br />Powhatan Avenue to a street light: and thence ~n a northerly ~irection <br />and at right angles to the right of way of Powhatan Avenue across the <br />right of way of Powhatan Avenue to the point of beginning. Said section <br />of street to which ~losure is requested is adjacent to Parcel 380-0070 of <br />tke Tax MaFs of the City oz Portsmouth. <br /> <br /> Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br /> Nays: None <br /> <br /> 85-197 Letter from the City Manager recommending adoption of a motion to inform the <br />State of the Cit)'s revised schedule to begin the second phase work for Lake Kilby Water <br />Treatment Plant. <br /> <br /> "Included in the 1984-89 Capital Improvements Plan ~s a project to fund the second <br />phase of improvements to the Cit) 's Lake Kilby Water Plant. <br /> <br /> <br />
