Manning. Owner, by C. <br /> Raeford Eure, Agent, for four apartment buildings containing eight uni~ <br /> each on property of the northwest corner of Deep Creek Boulevard and <br /> Benton Avenue, approved on first reading at the regular meeting of <br /> July 23, 1985. <br /> <br /> J. T. Warren, 35 Beacon Road, representing Highland Park/Highland Biltmore residents, <br />stated that the problems had been solved with the developer and supported the project for <br />units with the proffer that the developer had submitted. <br /> <br />28 <br /> <br />The following proffer was received: GHP 85-16 <br /> <br /> "As agent and engineer for Mr. Manning on the above referenced group housing plan, Mr. <br />Manning proffers to meet all conditions as recently agreed to between the citizens of the <br />Highland/Biltmore Community and himself. Listed below are items to be ~roffered: <br /> <br /> 1. 6'6- stockade type fence is to be erected along the perimeter of the property line <br />from approximately 50' west of Deep Creek Boulevard to approximately 25' northwest of Benton <br />Avenue, as shown on the plan submitted. <br /> <br /> 2. Forty-eight parking spaces will be constructed, two of which will be for handicapped <br />parking. <br /> <br /> 3. Heavy-duty playground equipment shall be placed for the use of the proposed apartment <br />tenants. <br /> <br /> We believe that this proffer meets all of the requirements as outlined to date between <br />the parties. Raeford Eure, Partner Hoggard-Eure Associates" <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was adoFted, <br />to include the proffer, on final reading and by the following vote: <br /> <br />"A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING PROJECT PURSUANT TO SECTION <br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING <br />OF 28 UNITS AT THE NCRTHWEST CORNER OF DEEP CREEK BOULEVARD AND BENTON AVENUE AND <br />DESIGNATED AS GHP-85-16. <br /> <br /> WHEREAS, Reubin Manning, ~as <br />the City of Portsmouth, Virginia, <br />project consisting of thirty-two <br />and Benton Avenue; and <br /> <br />made application pursuant to SectiOn 40-55 of the Code of <br />1973, for the granting and approval of a group housing <br />(32 units at the northwest ccrner of Deep Creek Boulevard <br /> <br /> ~VHEREAS~ the application <br />requirements of Section 40-55 <br />and <br /> <br />has been determined by the Planning Commission to have met the <br />of the Code of the City of Portsmouth, Virginia, 1973, as amend~ <br /> <br /> WHEREAS, the Planning Commission has reviewed said application and site plan <br />therewith and has recommended a conditional approval of said application limiting <br />merit to a portion of the requested property and permitting only twenty-eight (28) <br />constructed thereon; and <br /> <br />submitted <br />the develop- <br />units to be <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursuan <br />to Section 40-55 grants only an exemption from certain requirements for. residences as stated <br />in said section, and does not donstitute a waiver of any other requirement embodied in the <br />subdivision ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any othe <br />applicable local, state or federal law ore regulation; and <br /> <br />[; <br /> <br /> <br />
