<br />dated June 11, 1985 as shown on plans designated "Towne Point Apartments" filed with the appro
<br />priate officials of the City of Portsmouth, Virginia, such being made a part hereof, is hereb
<br />granted approval subject to the following terms and conditions:

<br /> 1. Tejo Lane, from the intersection private Road to Churchland Boulevard, should be
<br />dedicated as a sixty foot (60') right-of-way with thirty-six feet (36') pavement width~
<br /> 2. A standard site improvement plan must be submitted to the Department of Engineering
<br />and Technical Services for review and approval and include, but not be limited to, the
<br />following:

<br /> (a Dedicated eight feet (8') utility easement along the northern property
<br /> line for access to utilities.

<br /> (b) Adequate turning space in parking lots for sanitation vehicles.

<br /> 3. Occupancy of the eastern fifty percent (50%) of the property shall nos be granted
<br />until the private road is connected to a public street, either Bickford Parkway or Towne

<br /> Benton Avenue, approved on first reading at the regular meeting of
<br /> July 23, 1985.

<br /> J. T. Warren, 35 Beacon Road, representing Highland Park/Highland Biltmore residents,
<br />stated that the problems had been solved with the developer and supported the project for
<br />units with the proffer that the developer had submitted.

<br /> "As agent and engineer for Mr. Manning on the above referenced group housing plan, Mr.
<br />Manning proffers to meet all conditions as recently agreed to between the citizens of the
<br />Highland/Biltmore Community and himself. Listed below are items to be ~roffered:

<br /> 1. 6'6- stockade type fence is to be erected along the perimeter of the property line
<br />from approximately 50' west of Deep Creek Boulevard to approximately 25' northwest of Benton
<br />Avenue, as shown on the plan submitted.
<br />
<br /> 2. Forty-eight parking spaces will be constructed, two of which will be for handicapped
<br />parking.
<br />
<br /> 3. Heavy-duty playground equipment shall be placed for the use of the proposed apartment
<br />tenants.
<br />
<br /> We believe that this proffer meets all of the requirements as outlined to date between

<br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was adoFted,
<br />to include the proffer, on final reading and by the following vote:

<br />OF 28 UNITS AT THE NCRTHWEST CORNER OF DEEP CREEK BOULEVARD AND BENTON AVENUE AND
<br />DESIGNATED AS GHP-85-16.

<br />therewith and has recommended a conditional approval of said application limiting
<br />merit to a portion of the requested property and permitting only twenty-eight (28)
<br />constructed thereon; and

<br />applicable local, state or federal law ore regulation; and
