$2, <br /> <br />August 13, 1985 <br /> <br />The following citizens spoke in opposition of the amendment: <br /> <br />Leslie R. French, III, 208 Glasgow Street <br />Sidney Tiesenga, 375 Middle Street, President of Olde Towne Civic League <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Whirl'ow, that CA 85-6 be deferred for 30 days, <br />and that the City Manager make any such reports that he might find availabe to the speakers, <br />and was adopted by 6-1 (Nay-Lucasl vote. <br /> <br /> (e) PARKING VARIANCES: <br /> <br /> (1) Request of Kirk Berkeley, architect, for a special exception to off-street <br /> parking requirements at 313 High Street in the Downtown D-1 District. <br /> <br /> Kirk Berkeley, 303 Effingham Street, representing T. A. Edwards and Jimmie Currin, who <br />have option on property, and spoke concerning the special exception for the residential use. <br /> <br /> Councilman Whitlow stated he would abstaxn on the matter as he was representing the <br />opponent. <br /> <br /> Robert Dolsey, President of Downtown Merchants Association, requested to speak. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Corprew, suspend the rules for Mr. Dolsey to <br />speak, and was adopted by 6-071[Abstaining-Whitlow)'vote. <br /> <br />Mr. Dolsey spoke concerning the 2-hour limit time of parking on High Street. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Beamer, to concur in the recommendation of the <br />Planning Commission, and request for parking variance was approved on first reading by 6-0-1 <br />(Abstaining-Whitlow) vote. <br /> <br />(2) Request of David Jordan for a special exception to off-street parking require- <br /> ments at 430 High Street in th& Downtown D-1 District. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Beamer, to defer the matter for 3( days, and was <br />adopted by unanimous vote. <br /> <br />UNFINSIHED BUSINESS <br /> <br />Consent Agenda <br /> <br />Item 85-167(b) was removed from the Consent Agenda, as requested. <br /> <br /> On motion of Mr. Grgy and seconded by Mr. Beamer, the following items approved on first <br />reading at the Public Hearing and regular meezing of July 23, 1985 were adopted on final <br />reading, and by the following vote: <br /> <br />85-206 Rezoning, use permit, and group housing projec~ applications: <br /> <br />(d) <br /> <br />'A~RESOLUTION GRANTING A USE PERMI? TO JANUARY 16TH ASSOCIATES TO OPERATE <br />GASOLINE PUMPS IN CONJUNCTION WITH A CONVENIENCE STORE ONTHE WEST SIDE OF <br />TOWNE POINT ROAD SOUTH OF BICKFORD PARKWAY. <br /> <br /> WHEREAS, January 16th Associates have made application pursuant to Section 40-70(b) of <br />the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permxt as here- <br />inafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all zhins required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use-permit. <br /> <br />NOW,~HEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permi~ hereinafter described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) <br />provements of <br /> <br />Will not be detrimental to the public use or injurious to the property or im- <br />the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. January 16th Associates is hereby granted a use permit pursuant to Section 40-70 (b) <br />of the Code of the City of Portsmouth, Virginia, 1973, to operate gasoline pumps in conjunt~io~ <br />with a convenience store on property on the west side of Towne Point Road lying south of <br />Bickford Parkway, such property being more particularly described as follows: <br /> <br />UP-85-14 <br /> <br /> Beginning at the southeast intersection of Towne Point Road and Bickford <br />Parkway (relocated); thence west along the south right-of'way of~Bickford Parkway <br />1S0', more or less; thence southerly 1S0', thence east 150' to the west right-of- <br /> <br /> <br />
