August 13~ 1985 <br /> <br /> At a regular meeting of the City Council held on Tuesday, August 13, 1985, there were <br />present: <br /> <br />James W. Holley, III, Ben A. Beamer, Sr., <br />L. Louise Lucas, Gloria O. Webb, Morton V. <br />Steven Lieberma~, City Attorney. <br /> <br />E. G~ Corprew, Jr., J. Robert Gray, <br /> ~hitlow, George L. Hanbury, City Manager, <br /> <br /> Rev. Milton E. Marks, Pastor of West End United Methodist Church, opened the meeting with <br />prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Lucas, minutes of the specia~ meeting of July <br />1985; minutes of the ca~led meeting of July 23, 1985; and minutes of the regular meeting of <br />July 23, 1985 to ~be approved as received, and was adopted by unanimous vote. <br /> <br />Mayor Holley welcomed all visitors in attendance. <br /> <br /> 85-221 Mayor Holley presented a montage to Charles B. ~hitehurs~, Chairman of the 1985 <br />Seawall Festival at Portside and commended Mr. Whitehurst for an outstanding even~. <br /> <br /> Mayor Holley presented a montage to P. Ward Robinstt, Jr., Chairman of the Portsmouth <br />Council of the Hampton Roads Chamber of Commerce; Mr. Robinett accepted a montage for Charles <br />Gwaltney, Chairman of the Portsmouth Partnership, who was unable to be present. Mayor Holley <br />commended Mr. Robinett and Mr. Gwaltney for their ass~srance and support to the Seawall Festiva <br /> <br />85-222 Public Hearing on use permit applications, proposed amendments to the City <br /> Code and parking variances: <br /> <br />(a) Use Permit UP 88-18 Use permit application of Norma B. McCoy, owner, for conv'- <br /> ~ersion to a duplex a~ 401 Mount Vernon Avenue. <br /> <br /> Harry DeHart, SS1 Florida Avenue, representing Port Norfolk Civic League, spoke in <br />opposition of the application. <br /> <br /> Norma B. McCoy, 401 Mount Vernon Avenue, requested to speak. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, to suspend the <br />speak, and was adopted by unanimous vote. <br /> <br />rules for Mrs. McCoy to <br /> <br />Mrs. McCoy, applicant, requested approval of the use permit. <br /> <br /> Motion of Mrs. L~cas and seconded by'Mrs. Webb, to concur in the recommendation of the <br />Planning Commission, was defeated by the following vote: (denying application) <br /> <br />Ayes: Corprew, Lucas <br />Nays: Beamer, Gray, Webb, l~itlow, Holley <br /> <br />(b) Use Permit UP 85-19 - Use permit application of Willie L. Saunders, owner, for <br /> conversion of a duplex at 59 Linden Avenue. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Beamer, to concur <br />Planning Commission, UP 85-19 for conversion t~ a duplex'at 89 <br />on first reading, and was adopted by unanimous vote. <br /> <br />in the recommendation of the <br />Linden Avenue, was approved <br /> <br /> (c) Use Permit UP 85-20 Use permit application of Cynthia B. Conner, contract owner, <br /> £0~ a ~hild Care center at 1127 Horne Avenue. <br /> <br /> George T. Robinson, 1121 Horne Avenue, representing neighborhood residents, concurred <br />with the recommendation of the Planning Commission to deny. ~ <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Lucas, to concur in the recommendation of the <br />Planning Commission, UP 85-20 was denied, and was adopted by the following vote: <br /> <br />Ayes~ Beamer, Corprew, Gray, Lucas, Webb, ~fhitlow, Holley <br />Nays: N6ne <br /> <br />(d) CA 85-6 - A proposal to amend Section 40 of the City Code pertaining~to temporary <br /> residence facilities, a new use classification. <br /> <br />The following citizens spoke in favor o£ the amendment: <br /> <br />Deb Anderson, 850 Crawford Parkway, representing Portsmouth General Hospital (presented <br /> statement supporting the Chisholm House) (See Exhibit 85-222 (d) <br />Mary Mi.!Johnson, 308 North Street, representing Chisholm House <br />Rev. Mbchel M0r~s=Hend~i~703 Summers Place, representing Monumental United Methodis-t <br />Anne.Long, 4439 Winchester Drive <br /> <br /> The following citizens spoke in opposition of the amendment: <br /> Jay Caspez; 58 Park View Avenue, representing Park View Civic League <br /> David Leonard, Rudwall Apts., Middle Street, representing Olde Towne Civic <br /> Rev. Jim Hundley, 1023 Naval Avenue <br /> Motion of Mr. Gray and seconded by Mrs. Webb, that Rev.
