103 <br /> <br />A~l~l- 97, ](:}gq <br /> <br /> WHEREAS, the City owns certain <br />longer needed by the City for public <br />and <br /> <br />hereinafter-described real property which property is no <br />purposes and is hereby declared to be surplus property; <br /> <br /> WHEREAS, Portsmouth Redevelopment ~ Housing Authority by due notice and advertisement <br />has requested proposals for the acquisition, use and development of said property and has <br />recommended the approval of the plan of Master Develonment Corporation; and <br /> <br /> WHEREAS, the City, Portsmouth Redevelopment ~ Honsing Authority and Master Development <br />Corporation have entered into a development agreement dated August 13, 1985 for acquisition, <br />use and development in accordance with the said approved plans; and <br /> <br /> WHEREAS, the said development agreement provides for the conveyance of said property to <br />Portsmouth Redevelopment ~ Housing Authority subject to certain easements and conditions <br />pertaining to access, maintenance and liability for damages on a portion of the property; and <br /> <br /> WHEREAS, the said acquisition, use and development plans have been included in the above- <br />referenced development agreement; and <br /> <br /> WHEREAS, Section 2.09 of the Charter of the City of Portsmouth provides that property may <br />be conveyed to the Commonwealth of Virginia, or a political subdivision thereof, without <br />advertisement or receipt of bids: and <br /> <br /> WHEREAS, Portsmouth Redevelopment ~ Housing Authority is a political subdivision of the <br />Commonwealth of Virginia; and <br /> <br /> WHEREAS, by plat entitled "Plat of Property Belonging to City of Portsmouth for Waterfront <br />Development", dated January 20, 1977, recorded in the Clerk's Office of the Circuit Court <br />of the City of Portsmouth, Virginia, in Map Book 10, page 6, certain hereinafter-described <br />easements and rights-of-way were dedicated Eot the purpose of constructing public utilities <br />and improvements; and <br /> <br /> WHEREAS, the proposed plan for <br />the hereinafter-described easements <br />struction and development; and <br /> <br />deveIopment by Master Development Corporation requires thai <br />and rights-oE-way be. released ~n order to facilitate con- <br /> <br /> WHEREAS, the said easements and rights~of-way are no longer required by the City for <br />public utility purposes and are hereby declared to be surplus property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth that the City <br />Manager be, and he hereby is, authorized to convey parcels 6lA, 61D, 61E, 61F and 61G as shown <br />on that certain plat entitled "Plat Showing Survey of Development Parcel 6lA thru 61G, Crawfor~ <br />Renewal Project, FAR-S3", prepared by A.M.L. Surveymng, dated April 17, 1985, revised May 16, <br />1985, and June 14, 1985, attached hereto, subject to the terms and conditions of a certain <br />development agreement between the City, Portsmouth Redevelopment ~ Hou§ing Authority and <br />Master Development Corporation dated August 13, 1985, and subject to conditions and restrictio~ <br />of record pertaining thereto. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby instructed to retain easements on <br />a portion of the subject property for pedestrian access and access for emergency and service <br />vehicles and ~o convey a portion of the subject property subject to certain conditions per- <br />taining to maintenance thereof and liability for damages; said easements and conditions to <br />apply to parcels 61D, 61E, 61F and 61G. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager, and he <br />certain hereinafter-described easements and rights-of-way <br />of said property: <br /> <br />hereby is, authorized to release <br />in connection with the conveyance <br /> <br />Parcel I <br /> <br /> All that certain 1S' drainage easement as shown on that certain plat <br />entitled "Plat of Property Belonging to City of Portsmouth for Waterfront <br />Development," recorded in the Clerk's Office of the Circuit Court of the <br />City of Portsmouth in Map Book 10, page 6; said easement being described <br />as lying along the eastern boundary of the property depicted on said plat <br />beginning at a point north of the northern right-of-way line of High Street <br />if thee same were extended from its intersection with Water Street eastwardly <br />to the Southern Branch of the Elizabeth River, and from thence extending ~n <br />a northerly direction between parellel lines iS' apart and parallel with the <br />existing seawall structure to a point south of the southern boundary of <br />London Street if the same were extended in an eastwardly direction fro~ its <br />intersection with Water Street ~o the Southern Branch of the Elizabeth River. <br /> <br />Parcel II <br /> <br /> All that certain 1S' drainage easement as shown on that certazn plat <br />entitled "Plat of Property Belonging to City of Portsmout~ for Waterfront <br />Development, recorded in the Clerk's Office of the Circuit Court of the <br />City of Portsmouth in Map Book 10, page 6: said easement being described <br />as beginning at a point on the eastern boundary of Water Street, said point <br />being south 3© 32' 15" east 222.5', more or less,, from the southeastern <br />intersection of Water Street and London Street as closed by ordinance adopted <br />by the Council of the City of Portsmouth June 22, 1976: and extending in a <br /> <br /> <br />
