April 14, 2026 <br /> <br />“ORDINANCE AUTHORIZING PAYMENT OF ESCHEATED FUNDS FROM THE TAX <br />SALE OF 3506 BLAINE STREET TO DAVID V. GILL AND DANIEL LEE BARNS AS <br />AUTHORIZED BY SECTION 58.1-3967 OF THE VIRGINIA CODE AND <br />APPROPRIATING THE SUM OF $9,525.24 FROM THE FUND BALANCE OF THE <br />GENERAL FUND TO THE FY 2026 GENERAL FUND BUDGET FOR SAID PURPOSE. <br />” <br /> <br />26-99b: <br /> <br />Adoption of an ordinance accepting a settlement payment in the amount of <br />$198,550 from AXA Insurance and appropriating said funds to the Seawall project <br />in the FY 2026 Capital Improvement Fund to reimburse the cost of repairs <br />necessitated by a ferry hitting the seawall. <br /> <br />Background: <br /> <br /> The Portsmouth seawall was damaged by the HRT Ferry. <br /> <br /> The City has completed all work necessary to repair the damage. <br /> <br /> The insurance company for the Ferry Operator, Norfolk by Boat Inc., has agreed <br />to pay the City for the damage and the cost of the repairs. <br /> <br />Discussion: <br /> <br /> The settlement amount is $198,550, which was based on the initial contractor <br />quote for repair work. <br /> <br /> The actual work was completed for a total of $197,600. <br /> <br />Financial Impact: <br /> <br /> No local match is required as a condition of the funding. <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. The City then disburses the funds to the PPIC, which disburses them <br />to the applicant. <br /> <br /> <br /> <br /> <br />
