March 10, 2026 <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That Community Housing Partners Corporation is hereby granted a use <br />permit pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia to <br />construct and operate a two-building multifamily dwelling development having not to <br />exceed 39 total units at 2216 Waldron Avenue and 2220 Waldron Avenue (Tax Parcels <br />0465-0380 and 0465-0390), being more particularly described as: <br /> <br />UP-25-16 <br /> <br />2216 Waldron Avenue <br />(Tax Parcel 0465-0390) <br />2220 Waldron Avenue <br />(Tax Parcel 0465-0380) <br /> <br />ALL THOSE certain pieces, parcels, sections or lots of land, together with the easements <br />and appurtenances belonging thereto, situate in the City of Portsmouth, Virginia, and <br />being known, numbered and designated as the Eastern 180.00 feet of Lot (Section) 2 and <br />all of Lots (Sections) 3, 4, 5, 6 and 7, in Block K, as shown on the map entitled “Plat of <br />Garden Homes”, recorded in the Clerk’s Office of the Circuit Court of the City of <br />Chesapeake, Virginia, in Map Book 21, at Pages 68 and 69, the Southwest corner of such <br />property being a point on the North side of Waldron Avenue 60.00 feet East of Third Street <br />(now called Raven Street) together with all the right, title and interest appertaining thereto <br />in and to the platted lane designated as Waldron Avenue on the aforesaid plat, adjacent <br />to and south of the said property. <br /> <br />IT BEING Parcel Two of that certain property conveyed by Deed of Assumption between <br />Greenbrier Woods Corporation and Portsmouth-Afton Square, LP dated November 7, <br />2002 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number <br />020035943. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Without limitation, the development shall maintain compliance with the use-specific <br />standards set forth in Section 40.2-217(D)(1)(d) (Dwelling, Multi-Family) of the <br />Portsmouth Zoning Ordinance. <br /> <br />(b) The development shall be in substantial compliance with the conceptual site plan <br />entitled “Ansell Apartments – City of Portsmouth, Virginia”, prepared by Timmons Group <br />and dated December 18, 2025, except where modifications may be required to comply <br />with applicable local, state, or federal codes and regulations. <br /> <br />(c) The development shall in substantial compliance, including with respect to building <br />design and construction materials, with the rendering and concept exterior elevations <br />entitled “Ansell Building 1 – Exterior Elevation Renderings” and “Ansell Building 2 – <br />Exterior Elevation Renderings” prepared by Arnold Design Studio dated December 10, <br />2025, except where modifications may be required to comply with applicable local, state, <br />and federal codes or regulations. <br /> <br />(d) The existing vegetation located in a 10-foot wide strip along the southern property <br />line abutting existing single-family residences shall be retained to the maximum extent <br />possible. <br /> <br />(e) The development shall include not more than 39 multifamily dwelling units with <br />associated facilities and amenities. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
