<br />Together with that certain tract, piece or Parcel of land, situate, lying and being in the City
<br />of Portsmouth, Virginia, and being the western 139.07’ of the parcel designated as “Now
<br />or Formerly Portsmouth City School Board (D.B. 1260, Pg. 501)” as shown on plat
<br />recorded in Map Book 18, at Pages 95 and 96.
<br />
<br />LESS AND EXCEPT those certain tracts, pieces or parcels of land, situate, lying, and
<br />being in the City of Portsmouth, Virginia, described as follows:
<br />
<br />(i) A 60’ x 100’ parcel fronting 60 feet on Greenwood Drive (formerly Langley Boulevard),
<br />being a part of the property conveyed from Foundation Boys Academy, Inc., a Virginia
<br />corporation, to The County School Board of Norfolk County, Virginia, by Deed dated April
<br />4, 1958, recorded in the Clerk’s Office of the Circuit Court of the City of Chesapeake
<br />(formerly Norfolk County), Virginia, in Deed Book 1260, at Page 501;
<br />
<br />(ii) The property conveyed from Foundation Boys Academy, Inc., a Virginia corporation,
<br />to the City of Portsmouth, a municipal corporation of the Commonwealth of Virginia, by
<br />Deed dated October 24, 1962, recorded in the Clerk’s Office of the Circuit Court of the
<br />City of Portsmouth, Virginia in Deed Book 393, at Page 155;

<br />(iii) The property conveyed from Foundation Boys Academy, Inc., a Virginia corporation,
<br />to the City of Portsmouth, a municipal corporation of the Commonwealth of Virginia, by
<br />Deed dated April 8, 1975, recorded in the Clerk’s Office of the Circuit Court of the City of
<br />Portsmouth, Virginia in Deed Book 662, at Page 38.

<br />All those certain lots, pieces or parcels of land, with the buildings and improvements
<br />thereon, lying, situate and being in the City of Portsmouth, Virginia, and being known,
<br />numbered and designated as “Parcel 3, 13,852 square feet or 0.318 acres” and “Parcel
<br />4, 9,319 feet or 0.214 acres”, as shown on that certain plat entitled “Plat Showing Property
<br />Exchange Between the City of Portsmouth and Portsmouth Venture One, L.L.C.
<br />Portsmouth, Virginia” dated May 25, 2006, prepared by LandMark Design Group recorded
<br />in the Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book
<br />21, at Page 29.

<br />Conveyance to City of Portsmouth:

<br />LESS AND EXCEPT that portion of property which was conveyed to the City of
<br />Portsmouth, Virginia, a political subdivision, by deed from Portsmouth Venture One, LLC,
<br />a Virginia limited liability company, dated June 23, 2006 and recorded July 19, 2006 in
<br />the Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia as Instrument No.
<br />060015231 and as shown as “Parcel 1” and “Parcel 2” on that certain plat recorded at
<br />Map Book 21 Page 29.

<br />LESS AND EXCEPT:

<br />All those certain lots, pieces or parcels of land, with the buildings and improvements
<br />thereon, lying, situate and being in the City of Portsmouth, Virginia being known,
<br />numbered and designated as Lots 78-89, inclusive, Lots 110-125, inclusive, Lots 162-
<br />175, inclusive, Lots 180-183, and Lots 194, 195, 196, as shown on that certain plat
<br />entitled, “Subdivision Creating New Port, Section 3, Portsmouth, Virginia,” dated January
<br />4, 2007, and prepared by Land Mark Design Group, Engineers-Planners-Surveyors, and
<br />recorded in the Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia in
<br />Map Book 21, at Page 108.
