November 25, 2025 <br /> <br />25 - 335 - Adoption of an ordinance accepting a Dam Safety, Flood Prevention and <br />Protection Assistance Fund grant in the amount of $334,117.76 from the Virginia <br />Department of Conservation and Recreation and appropriating said amount in the <br />Dam Upgrades Project in the Water Category of the FY 2026 Capital Improvement <br />Fund Budget for the preliminary engineering report necessary to evaluate the <br />spillway at Lake Kilby Dam. <br /> <br />Background: <br /> <br /> Virginia Dam Safety, Flood Prevention and Protection Assistance Fund state <br />grants help dam owners and Virginia localities enhance public safety and reduce the risk <br />of dam failures and property damage from flooding. <br /> <br /> The fund was established to provide grants to public and private dam owners <br />whose dams are under state regulation, and to help local governments improve methods <br />for flood prevention and protection. <br /> <br />Discussion: <br /> <br /> The City submitted an application to assist in funding the preliminary engineering <br /> <br />reports that are required (by regulations) for the Lake Kilby Dam. <br /> <br /> The Lake Kilby dam has a Conditional O&M Certificate for Compliance. The dam <br />requires significant rehabilitation to meet current regulatory standards. <br /> <br /> The preliminary engineering report is required to develop the design parameters <br />for the rehabilitation. This grant is for the geotechnical investigation and/or structural <br />evaluation necessary for the preliminary engineering report. <br /> <br /> The grant is reimbursable and requires a dollar-for-dollar local match. <br /> <br />Financial Impact: <br /> <br /> The grant amount is $334,117.76. A dollar-for-dollar local match is required as a <br />condition of the grant funding, which match has previously been appropriated to the FY <br />2026 Capital Improvement Fund Budget. <br /> <br /> The total project cost is $668,235.52, of which $334,117.76 will be funded by the <br />grant and $334,117.76 will be funded by previously appropriated local CIP funding. <br /> <br />Recommended Action: <br /> <br /> Adoption of the Ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> Sign and return grant agreement to the Virginia Department of Conservation and <br />Recreation. <br /> <br />“ORDINANCE ACCEPTING A DAM SAFETY, FLOOD PREVENTION AND <br />PROTECTION ASSISTANCE FUND GRANT IN THE AMOUNT OF $334,117.76 FROM <br />THE VIRGINIA DEPARTMENT OF CONSERVATION AND RECREATION AND <br />APPROPRIATING SAID AMOUNT IN THE DAM UPGRADES PROJECT IN THE <br />WATER CATEGORY OF THE FY 2026 CAPITAL IMPROVEMENT FUND BUDGET <br />FOR THE PRELIMINARY ENGINEERING REPORT NECESSARY TO EVALUATE THE <br />SPILLWAY AT LAKE KILBY DAM. <br />” <br /> <br />25 - 336 - Adoption of a resolution approving the 2025 edition of the Emergency <br />Operations Plan for the City of Portsmouth. <br /> <br />Background: <br /> <br /> The Federal Emergency Services Disaster Law requires that the Commonwealth <br />of Virginia, and each county or city thereof, develop and maintain a current Emergency <br />Operations Plan. <br /> <br /> Virginia Code § 44-146.19(E) provides that each subdivision within the <br />Commonwealth shall be within the jurisdiction of and served by the Department of <br />Emergency Management, and be responsible for local disaster mitigation, preparedness, <br />response and recovery. Each political subdivision shall maintain in accordance with state <br />disaster preparedness plans and programs an agency of emergency management which <br />has jurisdiction over and services the entire political subdivision. <br /> <br /> <br /> <br /> <br /> <br />
