November 25, 2025 <br /> <br />“ORDINANCE APPROPRIATING $3,460,000 FROM THE FUND BALANCE OF THE <br />BEHAVIORAL HEALTHCARE SERVICE FUND TO THE FY 2026 BEHAVIORAL <br />HEALTHCARE SERVICE FUND BUDGET AND TRANSFERRING SAID FUNDS TO <br />THE MUNICIPAL FACILITIES SECTION OF THE FY 2026 CAPITAL IMPROVEMENT <br />FUND BUDGET FOR THE PURPOSE OF PERFORMING REMODELING AND ROOF <br />REPAIRS AT THE BHS OFFICES LOCATED AT 1811 KING STREET AND 2011 <br />QUEEN STREET.” <br /> <br />25 - 342 - Adoption of a resolution authorizing the reconveyance of properties <br />containing stormwater ponds that serve the Martin Luther King Extension to the <br />Commonwealth of Virginia or its designated agency. <br /> <br />Background: <br /> <br /> After completion of a state road project located within a locality, the Virginia <br />Department of Transportation (VDOT) requires localities to accept conveyance of excess <br />property that was acquired by VDOT for the project but not incorporated into the road <br />improvements. <br /> <br /> Upon completion of the Martin Luther King Extension project in 2020, VDOT <br />conveyed 51 remnant parcels to the City. <br /> <br /> Among the 51 parcels, VDOT mistakenly included several small parcels that had <br />been developed with stormwater management ponds that serve the MLK Extension. <br /> <br /> VDOT has now requested that the City re-convey parcels covered by stormwater <br />ponds to the Commonwealth. <br /> <br />Discussion: <br /> <br /> The fifteen parcels are: 1301, 1303, 1305, 1400, 1401, 1403, 1405, 1407, 1409, <br /> <br />1411, 1413, and 1415 Columbus Avenue and 2122, 2126, and 2130 Columbia Street. <br /> <br /> All of the parcels are covered with stormwater ponds, of no value to the City, and <br />necessary for stormwater drainage from the highway system. <br /> <br /> VDOT has requested the reconveyance for maintenance purposes. The ponds <br />will be maintained by or on behalf of VDOT and the City will incur no maintenance costs. <br /> <br />Financial Impact <br /> <br /> The City will not incur any maintenance costs for the stormwater ponds. <br /> <br />Recommended Action: <br /> <br /> Adoption of the Resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute and deliver one or more deeds conveying the <br />parcels to the Commonwealth. <br /> <br />“RESOLUTION AUTHORIZING THE RECONVEYANCE OF PROPERTIES <br />CONTAINING STORMWATER PONDS THAT SERVE THE MARTIN LUTHER KING <br />EXTENSION TO THE COMMONWEALTH OF VIRGINIA OR ITS DESIGNATED <br />AGENCY. <br /> <br /> WHEREAS, <br />the Virginia Department of Transportation completed the Martin <br />Luther King Extension Project; and <br /> <br />WHEREAS, <br /> in accordance with state policy, after completion of the Project VDOT <br />conveyed excess property that it had acquired for, but not incorporated into, the Project <br /> <br />to the City; <br /> <br />WHEREAS, <br /> VDOT mistakenly included fifteen small parcels containing <br />stormwater ponds that serve the highway in the conveyance to the City; and <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
