August 26, 2025 <br /> <br />(c) Z-25-01 CITYWIDE - Ordinance granting the proposal to amend and <br />reenact City Code Chapter 40.2 (Zoning Ordinance) Sections 40.2- <br />217 (Use-Specific Standards) and 40.2-533 (Use Permits), and <br />Division V of Article V (Enforcement), for the purpose of modifying <br />(1) the regulations applicable to Event Space/Banquet Halls, <br />Entertainment Establishments, and similar uses and (2) the <br />enforcement authority of the Zoning Administrator. Related <br />changes to additional sections of the Zoning Ordinance may also <br />be discussed at the Public Hearing. Planning Commission <br />recommends approval. <br /> <br />1. David House, P. O. Box 3002, voiced his concern with the proposed changes to off- <br />street parking. <br /> <br />2. Steve Carroll, 312 Riveredge Drive, asked what the penalties would be for violators. <br /> <br />3. Daniel House, 114 Gillis Road, voiced his concern with how off-street parking will be <br />maintained and secured. <br /> <br />4. Coleman Young, 603 Dinwiddie Street, voiced his concern with the inability to have <br />promoters or third-party events. He also voiced his concern with giving power to <br />close a business that is in violation to the zoning administrator. <br /> <br />5. Vincent Majors, 228 Monmouth Street, voiced his concern with clubs near his house <br />and the negative impact on the neighborhood. <br /> <br />6. Gregory McCoy, 101 Shipmate Way, voiced his concern with clubs near his house <br />ant the negative impact on the neighborhood. <br /> <br />7. Nicole Adams, 35 Frailey Place, voiced her concern with the inability to have <br />promoters or third-party events. <br /> <br />8. Velma Brown, 5142 Castleway, spoke on the importance of having entertainment for <br />those over 35 years of age. <br /> <br />Motion by Mr. Hugel, and seconded by Ms. Bryant, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN CHAPTER 40.2 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (ZONING ORDINANCE) TO ADD AND MODIFY <br />REQUIREMENTS AND ENFORCEMENT REGULATIONS FOR ENTERTAINMENT <br />ESTABLISHMENTS, EVENT PLACES, AND RESTAURANTS, AND TO ESTABLISH <br />AND REGULATE A NEW USE CATEGORY FOR PRIVATE CLUBS, BY AMENDING <br />SECTION 40.2-212 (PUBLIC AND INSTITUTIONAL USES), SECTION 40.2-217 (USE- <br />SPECIFIC STANDARDS), TABLE 40.2-216 (USE TABLE) AND TABLE 40.2-301(1) <br />(MINIMUM OFF-STREET PARKING STANDARDS), AND ADDING A NEW SECTION <br />40.2-255 (REVOCATION OF PERMITS).” <br /> <br />Ayes: Bryant, Dodson, Hugel, Moody, Glover <br />Nays: Thomas, Tillage <br /> <br />- Unfinished Business - <br /> <br />25 - 137 - Use permit: <br /> <br />25-137(b) <br /> <br />1.
