<br /> 2. That it has considered factors it deemed applicable and consistent with the
<br />Code of Virginia, which may include, without limitation, the nature, extent, external effects,
<br />location, design or method of operation of the requested use, the City’s comprehensive
<br />plan, and the public health, safety, and general welfare.
<br />
<br /> 3. That it has considered the imposition of conditions regarding the location,
<br />character, and other features of the proposed use and finds and determines that the
<br />conditions imposed by this Resolution are necessary to ensure compliance with the
<br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse
<br />effects from the proposed use.
<br />
<br /> 4. That based on its review and consideration, it has determined that the use
<br />GRANTED WITH CONDITIONS
<br />permit requested by the subject application should be
<br />as provided in this Resolution.
<br />
<br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the
<br />Code of the City of Portsmouth, Virginia to construct a total of not to exceed seventeen
<br />townhouse units on approximately 1.7 acres of the property having an address of 1200
<br />Hodges Ferry Road (Tax Parcel 0618-0420), the said property being more particularly
<br />described as:

<br />ALL THAT certain tract, piece or parcel of land, situate in the City of Portsmouth, Virginia,
<br />designated as Site “A” containing 6.57 acres, more or less, and bounded and described
<br />according to that certain plat entitled “Plat of Site A, Mayflower Park, Portsmouth, Va.”
<br />dated April 1963, made by Armistead & Beck, Civil Engineers and Surveyors, as follows:
<br />Beginning at a steel pin at the intersection of the northern line of Logan Drive and the
<br />western line of Hodges Ferry Road as widened to eighty (80) feet, as shown on the plat;
<br />thence N. 36° 39’ 30” W. 133.23 feet; thence on a curve to the left having a radius of
<br />9,167.50 feet, an arc distance of 200 feet to a pin; thence N. 37° 54’ 30” W. 227.23 feet
<br />to a point in the southern line of the property of America Lodge #330 A.F. & A.M.; thence
<br />along the southern line of the property of the said Lodge S. 50° 11’ W. 259.76 feet to a
<br />point; thence along the western line of the Lodge and the C. & P. Telephone Company
<br />site N. 39° 49’ W. a distance of 319.81 feet to a point; thence S. 50° 11’ W. a distance of
<br />188.58 feet to the rear lot line of lots numbered 87 through 97 on the plat of Mayflower
<br />Park Section 3, which plat is duly recorded in the Clerk’s Office of the Circuit Court of
<br />Norfolk County, Virginia, now the City of Chesapeake, Virginia, in Map Book 38, Page 39;
<br />thence along the abovementioned rear lot line S. 41° 21’ 30” E. a distance of 856 feet to
<br />the northern line of Logan Drive; thence along the northern line of Logan Drive N. 50° 11’
<br />E. a distance of 401.20 feet, more or less, to the point of beginning.

<br />IT BEING all that certain property conveyed to the Trustees of the Central Baptist Church
<br />by Deed of Bargain and Sale from Lenoard G. Karp, et ux., et als. dated May 1, 1963 and
<br />recorded in the Portsmouth Circuit Court Clerk’s Office in Deed Book 402 at Page 315.

<br /> 6. That the use permit is approved subject to the following conditions which
<br />shall be observed by the applicant and any successor in interest:
<br />
<br />(a) The development shall be in substantial compliance with the concept plan entitled
<br />Logan Towns Concept C prepared by Coastal Developers LLC dated June 16, 2025,
<br />except where modifications may be required to comply with all applicable local, state, and
<br />federal codes and regulations, including City Code Chapter 14.1 (Flood Protection).
<br />
<br />(b) The proposed development of the subject property shall not include more than
<br />seventeen (17) townhouses.
