<br />June 24, 2025 <br /> <br />WHEREAS <br /> , by Resolution R-23-30 adopted on June 13, 2023, City Council <br />granted Use Permit UP-23-07 to construct four townhouses at 3002 and 3006 Deep <br />Creek Boulevard (Tax Parcels 0145-0190 and 0145-0200); and <br /> <br />WHEREAS <br /> , Section 40.2-533(K)(1) of the Zoning Ordinance provides in pertinent <br />part that “a Use Permit shall automatically expire and become void two years from the <br />date of approval by City Council if the use is inactive or changed to a different use, unless <br />within such two-year period…a building permit is obtained and erection or alteration of a <br />structure is started…”; and <br /> <br />WHEREAS, <br /> pursuant to Virginia Code Section 15.2-2209.1:1, which was adopted <br />by the Virginia General Assembly to automatically extend local approvals to address the <br />COVID-19 pandemic, the original expiration date for UP-23-07 was extended to July 1, <br />2025; and <br /> <br />WHEREAS, <br /> Section 40.2-533(K)(3) of the Zoning Ordinance authorizes City <br />Council to extend the expiration date of Use Permits once for a period of not to exceed <br />one year provided that a written application for the extension is submitted to the Planning <br />Department at least 30 days prior to the expiration of the Use Permit; and <br /> <br />WHEREAS, <br /> New Home Builders Inc. has timely submitted an application to extend <br />the expiration date of UP-23-07 for a period of one year from July 1, 2025; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br /> <br />Virginia that the expiration date of UP-23-07 is hereby extended until July 1, 2026.” <br /> <br />Ayes: Bryant, Dodson, Hugel, Thomas, Tillage, Glover <br />Nays: None <br /> <br /> Mayor Glover thanked Mr. Gill Bland, Urban League CEO, for supporting the <br /> <br />Juneteenth Festival. <br /> <br /> Mayor Glover thanked Deputy City Manager Coleman for standing in for City Manager <br /> <br />Carter during his absence. <br /> <br />25 - 184 - Report on Pending Items <br /> <br /> <br /> City Manager Carter provided an update on the following: <br /> Launch of new billing system. <br />˗ <br /> Crawford Street roundabout and ribbon cutting. <br />˗ <br /> Traffic calming in the Waterview neighborhood. <br />˗ <br /> <br /> Mr. Hugel informed City Manager Carter of additional manhole covers that need to be <br /> <br />replaced on Cedar Lane. <br /> <br /> Dr. Dodson thanked City Manager Carter for the traffic calming devices. He also <br /> <br />requested a traffic study in Westhaven. <br /> <br />25 - 185 - Non-Agenda Speakers <br /> <br />1. Sergio Neal, 1420 Elm Avenue, thanked the City for fostering positive relationships <br /> with community organizations. He also informed citizens and City Council of New <br /> Generation summer youth band. <br /> <br /> <br /> Councilwoman Bryant inquired about Portsmouth United Summer Youth Program. <br /> <br /> <br /> City Manager Carter will provide an update. <br /> <br />2. Donna Biggs, 3104 Garland Drive, spoke on the importance of communication and <br />structure within the City. <br /> <br />3. Sheila Joseph, 139 Grand Street, thanked City Manager Carter and staff for the new <br />billing system. She also asked if there will be credit for erroneous late fees. <br /> <br /> <br /> <br /> <br />
