May 27, 2025 <br /> <br />Ayes: Bryant, Dodson, Hugel, Moody, Thomas, Tillage, Glover <br />Nays: None <br /> <br />25 - 143 - Adoption of a resolution authorizing the granting of a temporary <br />construction easement encumbering 11,596 square feet of 1227 Holland Road to <br />the City of Suffolk in furtherance of the Speights Spillway Bridge Replacement <br />Project. <br /> <br />Background: <br /> <br /> The City of Suffolk has received permission from VDOT to perform a project to <br />replace the Speights Spillway Bridge. <br /> <br /> In furtherance of the project, Suffolk has requested that Portsmouth grant a <br />temporary construction easement over 11,596 square feet of 1227 Holland Road. <br /> <br /> The proposed easement would be temporary last until completion of the project. <br /> <br />Discussion: <br /> <br /> Speights Spillway spills from Speights Run into Lake Kilby and is an important part <br />of the Portsmouth water system. <br /> <br /> The grant of the easement will benefit Portsmouth in two ways: First, the repair is <br />necessary and a failure of the Speights Spillway Bridge would damage the Spillway and <br />the water system. Second, provisions have been inserted into the draft easement <br />document that: (1) require Suffolk to protect the Spillway and repair any damage at its <br />sole cost; and (2) allow Portsmouth to monitor the Project to ensure that the Spillway is <br />not damaged. <br /> <br />Financial Impact: <br /> <br /> <br /> There is no financial impact. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute and deliver the temporary construction easement. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Hugel, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE GRANTING OF A TEMPORARY <br />CONSTRUCTION EASEMENT ENCUMBERING 11,596 SQUARE FEET OF 1227 <br />HOLLAND ROAD TO THE CITY OF SUFFOLK IN FURTHERANCE OF THE SPEIGHTS <br />SPILLWAY BRIDGE REPLACEMENT PROJECT. <br /> <br /> WHEREAS, <br />the Virginia Department of Transportation has approved Suffolk’s <br />plans for the Speights Spillway Bridge Replacement Project (the “Project”); and <br /> <br />WHEREAS, <br /> Suffolk has requested that the City of Portsmouth grant a temporary <br />construction easement encumbering 11,596 square feet of 1227 Holland Road in <br />furtherance of the Project; and <br /> <br />WHEREAS, <br /> the Speights Run Spillway flows from Speights Run to Lake Kilby and <br />is an important part of the Portsmouth water system; and <br /> <br />WHEREAS, <br /> it is therefore in the City’s interest to ensure that the Spillway Bridge <br />is replaced so that it does not fail; and <br /> <br />WHEREAS, <br /> the City of Suffolk has agreed to include language in the temporary <br />easement document to ensure that the Spillway is protected and that the City of <br />Portsmouth will have access to the Spillway during the Project for observation, inspection, <br />and testing; <br /> <br /> <br /> <br /> <br /> <br /> <br />
