Next Steps Following Council Action:  The City will advise the Virginia Workers’ Compensation Commission that the Resolution has been adopted. 1. Tiffany Stuart, 500 Broad Street, voiced concern with the delay in passing resolution. Motion by Mr. Moody, and seconded by Ms. Thomas, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION DECLARING THAT THE CITY OF PORTSMOUTH WILL PROVIDE THE WORKERS’ COMPENSATION PRESUMPTIONS UNDER VIRGINIA CODE SECTION 65.2-402(B) TO SALARIED EMERGENCY MEDICAL SERVICES PERSONNEL. WHEREAS, in 2021 the Virginia General Assembly amended § 65.2-402(B) of the Code of Virginia to allow localities, by adoption of a resolution, to extend the workers’ compensation presumptions as to death or disability from hypertension or heart disease to salaried emergency medical services personnel who have completed five years of service; and WHEREAS, emergency medical services personnel employed by the City of Portsmouth perform a valuable service to the community, frequently risking their health and safety for the citizens of the City; and WHEREAS, the City of Portsmouth values the services and sacrifices made by the emergency medical services personnel of the City; and WHEREAS, the City of Portsmouth desires to have its salaried emergency medical services personnel covered by the presumptions included in Va. Code § 65.2-402(B) for heart disease and hypertension to the maximum extent permitted by law; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that its salaried emergency medical services personnel, as that term is defined in Virginia Code § 32.1-111.1, who have completed five years of service in their position, shall be covered by the workers’ compensation presumption as to both hypertension and heart disease in Va.
