That it has considered the imposition of conditions regarding the location, character, and other features of the proposed use and finds and determines that the conditions imposed by this Resolution are necessary to ensure compliance with the general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse effects from the proposed use. 4. That based on its review and consideration, it has determined that the use GRANTED WITH CONDITIONS permit requested by the subject application should be as provided in this Resolution. 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the Code of the City of Portsmouth, Virginia, to operate an outdoor kennel on a parcel having an address of 3114 Tyre Neck Road (Tax Parcel 0815-0091), the said property being more particularly described as: UP-24-11 3114 Tyre Neck Road (Tax Parcel 0815-0091) ALL THAT certain lot, piece or parcel of land, with the buildings and improvements thereon, situate, lying and being in the City of Portsmouth, Virginia, being known, numbered and described as “Parcel A” as shown on the Plat entitled “Resubdivision of th Block 17, Part of Block 16 and Portion of 6 Street, Churchland Land Company”, made by Hassell & Folkes, Surveyors and Engineers, dated May 12, 1972, and recorded in the Clerk’s Office of the Circuit Court (formerly Court of Hustings) of the City of Portsmouth, Virginia in Map Book 8, page 29. IT BEING the same property conveyed to Corey Wilson Homes, LLC by Deed of Bargain and Sale from Churchland Glass & Mirror, Inc. dated November 1, 2023, and recorded in the Clerk’s Office of the Circuit Court for the City of Portsmouth, Virgina, as Instrument Number 202310639. 6. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The use-specific standard set forth in Section 40.2-217(G)(2)(d)(i) is hereby waived. The proposed use shall be designed and operated in accordance with the remaining use-specific standards for animal care uses set forth in Zoning Ordinance Sec. 40.2-217(G)(2). (b) Any outdoor runs or pens shall be located at least 10 feet from any lot line. (c) Outdoor operations shall be limited to the hours of 7:00 A.M. to 8:00 P.M. (d) The site shall be developed in compliance with all applicable codes, ordinances, and regulations of federal, state, and local government, and all required licenses and permits shall be obtained prior to the commencement of operation and remain in effect during the operation of the proposed use. (e) All taxes/fees associated with the property shall be paid when due, as determined by the City Treasurer. (f) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning Ordinance, which provides that this Use Permit may automatically expire and become void if certain conditions set forth therein are not satisfied within two (2) years of the date of approval by City Council. (g) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use Permit may be revoked by City Council after conducting a public hearing. This permit may be revoked if Council finds:
