January 14, 2025 <br /> <br /> 3. That it has considered the imposition of conditions regarding the location, <br />character, and other features of the proposed use and finds and determines that the <br />conditions imposed by this Resolution are necessary to ensure compliance with the <br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse <br />effects from the proposed use. <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia, to operate an outdoor kennel on a parcel having <br />an address of 3114 Tyre Neck Road (Tax Parcel 0815-0091), the said property being <br />more particularly described as: <br /> <br />UP-24-11 <br /> <br />3114 Tyre Neck Road <br />(Tax Parcel 0815-0091) <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, situate, lying and being in the City of Portsmouth, Virginia, being known, <br />numbered and described as “Parcel A” as shown on the Plat entitled “Resubdivision of <br />th <br />Block 17, Part of Block 16 and Portion of 6 Street, Churchland Land Company”, made <br />by Hassell & Folkes, Surveyors and Engineers, dated May 12, 1972, and recorded in the <br />Clerk’s Office of the Circuit Court (formerly Court of Hustings) of the City of Portsmouth, <br />Virginia in Map Book 8, page 29. <br /> <br />IT BEING the same property conveyed to Corey Wilson Homes, LLC by Deed of Bargain <br />and Sale from Churchland Glass & Mirror, Inc. dated November 1, 2023, and recorded in <br />the Clerk’s Office of the Circuit Court for the City of Portsmouth, Virgina, as Instrument <br />Number 202310639. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The use-specific standard set forth in Section 40.2-217(G)(2)(d)(i) is hereby <br />waived. The proposed use shall be designed and operated in accordance with the <br />remaining use-specific standards for animal care uses set forth in Zoning Ordinance Sec. <br />40.2-217(G)(2). <br /> <br />(b) Any outdoor runs or pens shall be located at least 10 feet from any lot line. <br /> <br />(c) Outdoor operations shall be limited to the hours of 7:00 A.M. to 8:00 P.M. <br /> <br />(d) The site shall be developed in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local government, and all required <br />licenses and permits shall be obtained prior to the commencement of operation and <br />remain in effect during the operation of the proposed use. <br /> <br />(e) All taxes/fees associated with the property shall be paid when due, as <br />determined by the City Treasurer. <br /> <br />(f) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the <br />Zoning Ordinance, which provides that this Use Permit may automatically expire and <br />become void if certain conditions set forth therein are not satisfied within two (2) years of <br />the date of approval by City Council. <br /> <br />(g) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use <br />Permit may be revoked by City Council after conducting a public hearing.
