196 November 26, 1985 At a regular meeting of the City Council held on Tuesday, November 26, 1985, there were present: James W. Holley, III., Ben A. Beamer, Sr., E. G. Corprew, Jr., J. Robert Gray, L. Louise Lucas, Gloria O. Webb, Morton v. Whitlow. George L. Hanbury, City Manager Steven Lieberman, City Attorney. Rev. T. M. Frye, Pastor of Biltmore Baptist Church, opened the meeting with prayer, followed by the Pledge of Allegiance to the Flag. Motion of Mr. Gray and seconded by Mr. 12, 1985; minutes of the regular meeting of and was adopted by unanimous vote. Mayor Holley responded on behalf of the City. - UNFINISHED BUSINESS Consent Agenda On motion of Mr. Gray and seconded by Mrs. Webb, the following items approved on first ~r~ad%ng at t~e. Public Hearing and regular meeting of November 12, 1985 were adopted on final ~a~d~[~-~%y the following vote: 85-340 Rezoning, use permit and group housing applications: (b) "ZONING AMENDMENT CRDINANCE Z 83-40- (c) "A RESOLUTION GRANTING A USE PERMIT TO THE FORTSMOUTH COMMUNITY SERVICES BOARD TO OPERATE GROUP RESIDENCE FOR ALCOHOL REHABILITATION AND TREATMENT AT 1000 GREEN STREET. WHEREAS, David M. Norman, Executive Director, Portsmouth Community Services Board, has made application pursuant to Section 40-121 (al (il of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be don in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE I7 RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will in the neighborhood not adversely affect the health and safety of persons residing or working of the Fropcsed use; (b) Will not be detrimental to the public use or injurzous to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. The Portsmouth Community Services Board is hereby granted a use permit pursuant to Section 4(-121 (a) ~i) of the Code of the City of Portsmouth, Virginia to operate a group home for adults for thirty-two ~32) residents for alcohol rehabilitation and treatment at 1000 Green Street (UP-85-27). 3. This use permit is approved subject to the following conditions: (a) OccuFancy is limited to thirty-two (32) residents unless Building and Officials of the City of Portsmouth determine a smaller number is required. Fire (b) All fire, building and health codes must be met prior to occupancy. lc) Off-street parking must be provided to accommodate the staff of the facility.
