The cost for projects, and any remuneration from a project, shall <br />only be shared by those member localities that join a Participation Agreement for the <br />project. <br /> <br /> There is no requirement to participate in any project and no penalties or adverse <br />consequences for a member locality that elects not to participate. <br /> <br /> The proposed ordinance would authorize the City of Portsmouth to join the <br />EVRIFA. <br /> <br />Financial Impact: <br /> <br /> The cost of membership in the EVRIFA is a $2,500 fee to join and membership <br /> <br />dues of $4,000 per year. <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> <br /> It is anticipated that the EVRIFA Board of Directors will approve the City’s request <br /> <br />to join. <br /> <br /> <br /> City Council will appoint two members to the EVRIFA Board of Directors. <br /> <br />Motion by Mr. Tillage, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE AUTHORIZING THE CITY TO JOIN THE EASTERN VIRGINIA <br />REGIONAL INDUSTRIAL FACILITY AUTHORITY PURSUANT TO SECTION 15.2- <br />6400 ET SEQ. OF THE CODE OF VIRGINIA (THE “ACT”). <br />” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Glover <br />Nays: Whitaker <br /> <br />24 - 369 - Adoption of an ordinance granting a renewal of a non-exclusive cable <br />franchise to Cox Communications Hampton Roads, LLC to construct, operate and <br />maintain a cable system in the city of Portsmouth. <br /> <br />Background: <br /> <br /> Cable companies are required to enter into Cable Franchise Agreements to <br />provide service in localities. <br /> <br /> The permissible terms and conditions that localities can require in Cable Franchise <br />Agreements are strictly regulated and limited by Chapter 21 of Title 15.2 of the Virginia <br />Code and further limited in franchise renewals by Section 626 of the Cable Act, 47 USC <br />§ 546. Nevertheless, there are certain terms that can be negotiated between a locality <br />and a provider. <br /> <br /> Portsmouth City Council granted a Cable Franchise Agreement to Cox <br />Communications with a commencement date of December 9, 2008, and later extended <br />the term of said agreement to December 10, 2024. <br /> <br />Discussion: <br /> <br /> The City has negotiated a renewal of Cox’s Cable Franchise Agreement with terms <br />and conditions benefitting the City to the greatest extent possible. <br /> <br /> The renewal Cable Franchise Agreement will have a 10-year term. <br /> <br />Financial Impact: <br /> <br /> None <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute the renewal Cable Franchise Agreement with Cox. <br /> <br /> <br /> <br /> <br />
