September 10, 2024 <br /> <br />(i) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use Permit <br />may be revoked by City Council after conducting a public hearing. This permit may be <br />revoked if Council finds: <br /> <br /> (i) The Use Permit was obtained by fraud or deception; <br /> (ii) The applicant has failed to comply with one or more of the conditions of <br />approval; <br /> (iii) There is a change in conditions affecting the public health, safety, and welfare, <br />since adoption of the Use Permit; or <br /> (iv) There are repeated violations of the Zoning Ordinance by the holder of the Use <br />Permit related to the development approved by the Use Permit. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />(c) UP-24-09 GEORGE WASHINGTON HWY - Resolution granting the request <br />of E. Hines for a Use Permit to operate an event space/banquet <br />hall in Suite 4646 of the shopping center at 4644 George <br />Washington Highway in the General Mixed-Use (GMU) zoning <br />district. The Future Land Use Map of the Build One Portsmouth <br />Comprehensive Plan designates this property as a mixed-use <br />corridor. The property is owned by BHG Capital LLC. Planning <br />Commission recommends denial. <br /> <br />1. Erica Hines, 4572 George Washington Highway, presented the application. <br /> <br />Motion by Dr. Whitaker, and seconded by Mr. Tillage, to defer Item 24-244c to the <br />September 24, 2024, City Council meeting, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: Hugel <br /> <br />- Unfinished Business - <br /> <br />24 - 76 - Innovation District Plan: <br /> <br />(c) AP-24-01 CITY-WIDE - Resolution granting the request of the City to adopt a <br />Plan for the Innovation District. The new document will be titled City <br />of Portsmouth Innovation District Plan. The Plan will recommend <br />strategies and tactics for achieving the identified goals, and <br />recommendations for funding and tools for implementing the <br />strategies and tactics. Deferred from the August 13, 2024, City <br />Council meeting. Planning Commission recommends approval. <br /> <br />1. JoAnn Clark, 4717 Thornwood Avenue, spoke in support of this item but offered some <br /> suggestions for improvement. <br /> <br />2. Michelle Wren, 739 high Street, spoke in support of this item. <br /> <br />3. Timothy Armstrong, 739 high Street, spoke in support of this item. <br /> <br />4. Tony Goodwin, 38 Linden Avenue, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION ADOPTING THE CITY OF PORTSMOUTH INNOVATION DISTRICT <br />PLAN. <br /> <br /> <br /> <br /> <br /> <br /> <br />
