September 10, 2024 (i) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use Permit may be revoked by City Council after conducting a public hearing. This permit may be revoked if Council finds: (i) The Use Permit was obtained by fraud or deception; (ii) The applicant has failed to comply with one or more of the conditions of approval; (iii) There is a change in conditions affecting the public health, safety, and welfare, since adoption of the Use Permit; or (iv) There are repeated violations of the Zoning Ordinance by the holder of the Use Permit related to the development approved by the Use Permit. REVOCATION OF PERMIT: 7. Violation of any of the conditions set forth herein may serve as grounds for revocation of the use permit by City Council.” Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None (c) UP-24-09 GEORGE WASHINGTON HWY - Resolution granting the request of E. Hines for a Use Permit to operate an event space/banquet hall in Suite 4646 of the shopping center at 4644 George Washington Highway in the General Mixed-Use (GMU) zoning district. The Future Land Use Map of the Build One Portsmouth Comprehensive Plan designates this property as a mixed-use corridor. The property is owned by BHG Capital LLC. Planning Commission recommends denial. 1. Erica Hines, 4572 George Washington Highway, presented the application. Motion by Dr. Whitaker, and seconded by Mr. Tillage, to defer Item 24-244c to the September 24, 2024, City Council meeting, and was adopted by the following vote: Ayes: Barnes, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: Hugel - Unfinished Business - 24 - 76 - Innovation District Plan: (c) AP-24-01 CITY-WIDE - Resolution granting the request of the City to adopt a Plan for the Innovation District. The new document will be titled City of Portsmouth Innovation District Plan. The Plan will recommend strategies and tactics for achieving the identified goals, and recommendations for funding and tools for implementing the strategies and tactics. Deferred from the August 13, 2024, City Council meeting. Planning Commission recommends approval. 1. JoAnn Clark, 4717 Thornwood Avenue, spoke in support of this item but offered some suggestions for improvement. 2. Michelle Wren, 739 high Street, spoke in support of this item. 3. Timothy Armstrong, 739 high Street, spoke in support of this item. 4. Tony Goodwin, 38 Linden Avenue, spoke in support of this item. Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION ADOPTING THE CITY OF PORTSMOUTH INNOVATION DISTRICT PLAN.
