July 9, 2024 <br /> <br />(a) In addition to all applicable general standards, the proposed use shall be designed <br />and operated in accordance with the use-specific standards for shipping <br />container/chassis storage yard uses outlined in Section 40.2-217(H)(3)(b) of the Zoning <br />Ordinance. <br /> <br />(b) Prior to commencing the use, a formal Site Plan must be approved by the <br />Engineering Department. <br /> <br />(c) Prior to commencing the use, a Zoning Clearance must be obtained from the <br />Zoning Administrator and a Business License must be obtained from the Commissioner <br />of the Revenue. <br /> <br />(d) If at any time a building is added to the site, the owner/operator must comply with <br />all applicable off-street parking and loading and circulation requirements of the Zoning <br />Ordinance, including without limitation the requirements of Section 40.2-301. <br /> <br />(e) The development must be constructed in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments, and all required <br />licenses and permits must be obtained prior to construction and remain in effect during <br />the operation of the development. <br /> <br />(f) All taxes/fees associated with the property shall be paid when due, as determined <br />by the City Treasurer. <br /> <br />(g) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years of the date <br />of approval by City Council. <br /> <br />(h) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use Permit <br />may be revoked by City Council after conducting a public hearing. This permit may be <br />revoked if Council finds: <br /> <br /> (i) The Use Permit was obtained by fraud or deception; <br /> (ii) The applicant has failed to comply with one or more of the conditions of <br />approval; <br /> (iii) There is a change in conditions affecting the public health, safety, and welfare, <br />since adoption of the Use Permit; or <br /> (iv) There are repeated violations of the Zoning Ordinance by the holder of the Use <br />Permit related to the development approved by the Use Permit. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />24 - 195 - Adoption an ordinance accepting Edward Byrne Memorial Justice <br />Assistance grant funds in the amount of $15,952 from the Virginia Department of <br />Criminal Justice Services and appropriating said amount in the FY 2025 Grants <br />Fund for use by the Portsmouth Police Department to acquire Automated External <br />Defibrillators. <br /> <br />Background: <br /> <br /> The Portsmouth Police Department (PPD) has been awarded grant funding from <br />DCJS to provide funds for law enforcement equipment. The grant includes $15,952 in <br />funding via DCJS and requires a local match from the City in the amount of $5,317, for a <br />total amount of $21,269. <br /> <br /> <br /> <br /> <br /> <br /> <br />
