November 14, 2023 <br /> <br />At a Regular Meeting of the City Council on Tuesday, November 14, 2023, there <br />were present: <br /> <br />Mayor Shannon E. Glover, Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., Dr. <br />Mark M. Whitaker, Mark A. Hugel, Vernon L. Tillage, Jr., Interim City Manager Mimi C. <br />Terry, City Attorney Lavonda Graham-Williams. <br /> <br />Mayor Glover asked for a moment of silence which was followed by the Pledge of <br />Allegiance to the Flag. <br /> <br /> Mayor Glover called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the minutes of <br />a Called Meeting of October 24, 2023, of a Regular Meeting of October 24, 2023, and of <br />a Called Meeting of November 6, 2023, and was adopted by the following vote: <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- Presentation - <br /> <br /> <br /> Presentation of a proclamation for “Small Business Saturday.” <br /> <br />- Public Hearings - <br /> <br />23 - 318 - Public hearings on code amendment and use permit applications: <br /> <br />(a) CA-23-02 CITY-WIDE - Ordinance granting the request of The City of <br />Portsmouth to amend City Code Ch. 40.2 Zoning Ordinance to allow <br />an applicant to apply for a Special Exception to request modification <br />of the required side yard setback for a single-family detached <br />dwelling on a lot that is 30 feet or less in width. Planning Commission <br />recommends approval. <br /> <br />1. Julie Chop, Manager, Planning Department, presented the application. <br /> <br />2. Gary Bunting, 416 Kay Road, spoke in support of this item. <br /> <br />3. Sheila Joseph, 139 Grand Street, voiced her concern with the inability to build on small <br /> plots of land. <br /> <br />4. William Britt, 5109 Moonlit Avenue, wanted clarification on whether this was for single <br /> family homes or duplexes. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Hugel, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE AMENDING AND RE-ORDAINING SECTION 40.2-535 (SPECIAL <br />EXCEPTIONS) OF ARTICLE V (ADMINISTRATION) OF CHAPTER 40.2 (ZONING) OF <br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA BY ADDING A NEW <br />SUBSECTION 40.2-535(B)(13) FOR THE PURPOSE OF AUTHORIZING SPECIAL <br />EXCEPTIONS FOR CERTAIN NARROW RESIDENTIAL LOTS.” <br /> <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
