September 12, 2023  It is necessary for City Council to accept and appropriate this additional disbursement.  The Settlement MOU requires the City to use the Settlement Funds for “Approved Abatement Purposes”, which it defines as: “efforts to treat, prevent, or reduce opioid use disorder or the misuse of opioids or to otherwise abate or remediate the opioid epidemic…”. Specific examples of Approved Abatement Purposes are described in Section (C)(4)(a) through (j) of the Settlement MOU.  The proposed ordinance appropriates the $82,778.38 allocation of Settlement Funds to the Department of Behavioral Healthcare Services for use for Approved Abatement Purposes. Financial impact:  No local match is required as a condition of the funding. Recommended Action:  Adoption of the ordinance. Next Steps Following Council Action:  BHS will expend the Settlement Funds for Approved Abatement Purposes. Motion by Ms. Lucas-Burke, and seconded by Mr. Tillage, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE ACCEPTING SETTLEMENT FUNDS IN THE AMOUNT OF $82,778.38 FROM THE NATIONAL OPIOIDS SETTLEMENT FUND TRUST AND APPROPRIATING SAID AMOUNT IN THE FY 2024 BEHAVIORAL HEALTHCARE SERVICE FUND FOR USE BY BHS FOR APPROVED ABATEMENT PURPOSES AS DEFINED BY THE VIRGINIA OPIOID FUND AND SETTLEMENT ALLOCATION MOU.” Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None 23 - 284 - Adoption of a resolution to approve and ratify the FY 2024/FY 2025 Community Services Performance Contract for the Portsmouth Department of Behavioral Healthcare Services. Background:  Community Service Boards (CSBs) shall submit their performance contracts to the local governments in their service areas for review and approval pursuant to Section 37.2- 508 or 37.2-608 of the Code of Virginia. Discussion:  The Virginia Department of Behavioral Health and Developmental Services (VDBHDS) issues a performance contract to each CSB on an annual or biennial basis. The Performance Contract specifies the services to be rendered through the local department of behavioral healthcare services for the next fiscal year relative to budgeted funding committed to the CSB for the funding period.  The Portsmouth Department of Behavioral Healthcare Services (DBHS) operating budget is approved annually by City Council during the City’s budget process. The Performance Contract displays this budget in the format required by the State.  The City must approve the Performance Contract in order for the CSB to receive the allocations of State and Federal dollars that fund the services provided by DBHS. The State and Federal dollars are received through the VDBHDS Office of Community Contracting. Financial Impact:  The total projected Cost for Services for the first year of the Performance Contract (Fiscal Year 2024) is $15,328,491.  The Cost for Services will be paid primarily from State and Federal funds. There is a local match of $973,572, which is budgeted as part of the FY 2024 BHS Budget.
