September 12, 2023 <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute and deliver any required documents to effectuate <br />the easement conveyance. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Hugel, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE CONVEYANCE OF A UTILITY EASEMENT <br />ENCUMBERING APPROXIMATELY 1,292 SQUARE FEET OF 1227 HOLLAND ROAD <br />(LAKE KILBY) TO VIRGINIA NATURAL GAS IN FURTHERANCE OF THE S.A.V.E. <br />PROGRAM TO UPGRADE NATURAL GAS LINE SYSTEMS IN THE <br />COMMONWEALTH. <br /> <br />WHEREAS, <br /> Virginia Natural Gas (“VNG”) currently has an exposed pipeline that <br />runs along the bridge over Lake Kilby that joins Holland Road and West Washington <br />Street; and <br /> <br />WHEREAS, <br />VNG is improving its infrastructure through the Steps in Advancing <br />Virginia’s Energy (S.A.V.E.) program; and <br /> <br />WHEREAS, <br />the goal of the program is to make necessary upgrades to natural gas <br />line systems to increase safety and reliability and lower operating costs; and <br /> <br />WHEREAS, <br /> in furtherance of the Project, VNG is requesting that the City convey <br />an easement encumbering approximately 1,292 square feet of Lake Kilby (1227 Holland <br />Road - Tax Parcel 34*35), as shown on Exhibit A; and <br /> <br />WHEREAS, <br /> the purpose of the easement is to allow VNG to replace the exposed <br />pipeline with a line running under the lakebed; and <br /> <br />WHEREAS, <br /> the Department of Public Utilities has reviewed the proposed <br />easement and determined that it will have no negative impact on Lake Kilby; and <br /> <br />WHEREAS, <br /> VNG has estimated the value of the easement as $516 and has <br />offered to pay the City that amount; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the conveyance of the requested <br />easement to VNG, and that the City Manager is hereby authorized to execute such <br />documents or instruments as may be necessary or desirable in furtherance of the intent <br /> <br />of this Resolution.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Whitaker, Glover <br />Nays: None <br />Abstain: Tillage (Employee relationship) <br /> <br />23 - 286 - Adoption of a resolution requesting the General Assembly of Virginia to <br />amend the Charter of the City of Portsmouth, Virginia by amending Section 3.02 <br />regarding nomination of candidates for City Council and Mayor and Section 3.04 <br />regarding City Council vacancies. <br /> <br /> <br />Background: <br /> <br /> Currently, Section 3.02 of the Charter provides that the deadline for the filing of <br />petitions for candidacy for Mayor or City Council and the acceptance of candidacy is “the <br />time fixed for the closing of the polls on the second Tuesday in June of the year of the <br /> <br />election”. <br /> <br /> The General Registrar reports that this language has caused confusion for two <br />reasons. First, there is not always an election on the second Tuesday in June and <br />therefore there is not always a “time fixed for the closing of the polls” on that date. <br />Second, the deadline for candidacy filings under state law is different – Section 24.2-507 <br /> <br />of the Virginia Code provides that the deadline is the third Tuesday in June at 7:00 p.m. <br /> <br /> <br /> <br /> <br /> <br />
