July 11, 2023 <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the concept plan entitled <br />SAFSTOR SELF STORAGE SITE PLAN EFFINGHAM STREET PORTSMOUTH, <br />VIRGINIA prepared by W&A Engineering dated December 7, 2020, except where <br />modifications may be required to comply with all applicable local, state, and federal codes <br />and regulations. <br /> <br />(b) The development shall be in substantial compliance, including with respect to <br />building design and construction materials, with the rendering and concept exterior <br />elevations titled SAFSTOR EFFINGHAM PORTSMOUTH, VA A1-4 prepared by ADB <br />Design Services dated March 21, 2023 and December 16, 2020, except where <br />modifications may be required to comply with all applicable local, state, and federal codes <br />and regulations. <br /> <br />(c) Landscaping shall be installed, at a minimum, in substantial compliance with the <br />landscape plan titled SAFSTORE SELF STORAGE LANDSCAPE CONCEPT PLAN <br />prepared by W&A Engineering dated May 26, 2022, subject to minor modifications <br />required to comply with all applicable local, state, and federal codes and regulations. This <br />condition is not intended to preclude additional landscaping beyond that shown in the <br />aforesaid landscaping plan, so long as the additional landscaping does not violate any <br />applicable code or regulation. <br /> <br />(d) Prior to issuance of a Certificate of Occupancy, the existing chain-link fence along <br />Effingham Street must be removed. <br /> <br />(e) Prior to initially operating the self-storage facility, and for so long as the facility <br />remains in operation, the owners and/or operators of the facility shall install and maintain <br />digital video equipment with recording capabilities sufficient to indicate the date and time <br />that the recording is made. The recording shall provide surveillance coverage <br />encompassing the front, side, and rear exteriors of the establishment during the operating <br />hours of the establishment and for at least one additional hour after the close of business. <br />Recorded data must be maintained in a condition permitting review of the information for <br />a period of no less than thirty days. <br /> <br />(f) All excavation, land disturbance, and construction/development activities on the <br />property shall be in full compliance with Article II of Chapter 11 of the Code of the City of <br />Portsmouth, Virginia (Excavation Requirements for Abex Superfund Site). <br /> <br />(g) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained prior to construction and remain in effect during <br /> <br />the operation of the development. <br /> <br />(h) All taxes/fees associated with the property shall be paid when due, as determined <br /> <br />by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7.
