May 23, 2023 <br /> <br />LESS AND EXCEPT that portion of such property which is designated as “PARCEL B-1” <br />on the plat entitled, “SUBDIVISION PLAT OF THE PROPERTY OF CLARIANT <br />CORPORATION, PORTSMOUTH, VIRGINIA”, dated December 2, 1998, (and signed <br />and sealed on December 4, 1998), prepared by engineering services, inc. and recorded <br />in the Clerk’s Office of the Portsmouth Circuit Court in Map Book 17, at pages 182 and <br />183. <br /> <br />AND LESS AND EXCEPT Lots 306, 308 and 310 shown as part of “PARCEL N” on the <br />survey entitled, “BOUNDARY SURVEY OF PROPERTY OF CLARIANT <br />CORPORATION”, dated 01-06-98, prepared by engineering services, inc. consisting of <br />three (3) sheets and recorded in the Clerk’s Office of the Portsmouth Circuit Court in Map <br />Book 17, at pages 74, 75 and 76. <br /> <br />IT BEING all that certain property conveyed to Roger E. Woodington and Glenda B. <br />Woodington, or their successor trustees, Trustees of the Roger E. Woodington Trust <br />dated January 26, 2007, as amended, and Glenda B. Woodington and Roger E. <br />Woodington or their successor trustees, Trustees of the Glenda B. Woodington Trust <br />dated January 26, 2007, as amended, as tenants in common, by Deed from Land and <br />Marine Remediation, Inc. dated January 4, 2010 and recorded in the Portsmouth Circuit <br />Court Clerk’s Office as Instrument Number 100000518. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The approved use shall be operated in compliance with the Shipping <br />Container/Chassis Storage Yard Use-Specific Standards set forth in Section 40.2- <br />217(H)(3)(b) of the Zoning Ordinance except to the extent expressly contradicted by <br />another condition in this Section 6. <br /> <br />(b) No more than three (3) shipping containers shall be stacked on top of one another. <br /> <br />(c) No chassis storage is permitted on the subject property. <br /> <br />(d) No shipping container storage is permitted at 3301 Mariner Avenue. <br /> <br />(e) The use shall not be commenced on the subject property until a Minor Subdivision <br />plat combining the parcels 3300 West Norfolk Road, 3324 West Norfolk Road, 3303 <br />Broadway Street, and 3307 Broadway Street and complying with all applicable <br />requirements of Chapter 33.1 of the City Code (Subdivisions) has been approved by the <br />City and recorded in the land records. Upon recordation of the said plat, this Use Permit <br />shall be applicable to the entire combined parcel. <br /> <br />(f) The use shall not be commenced on the subject property until a formal site plan <br />has been reviewed and approved by the City Engineering Department. <br /> <br />(g) Prior to obtaining a Zoning Permit, and for so long as the approved use continues <br />on the subject property, the owners and/or operators shall install and maintain digital <br />video equipment with recording capabilities sufficient to indicate the date and time that <br />the recording is made. The recording shall provide surveillance coverage encompassing <br />the use area for 24 hours a day, 7 days a week. Recorded data must be maintained in a <br />condition permitting review of the information for a period of no less than thirty days. <br /> <br />(h) The approved use shall be conducted in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government. All required licenses <br />and permits shall be obtained prior to commencement of the approved use and <br />maintained in good standing at all times during the operation of the use. <br /> <br />(i) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
