March 28, 2023 Motion by Ms. Lucas-Burke, and seconded by Mr. Tillage, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE ACCEPTING A COVID-19 VACCINE AND HEALTH EQUITY GRANT IN THE AMOUNT OF $14,627 FROM THE VIRGINIA DEPARTMENT OF HEALTH AND APPROPRIATING SAID AMOUNT IN THE FY 2023 GRANTS FUND FOR USE BY THE DEPARTMENT OF LIBRARIES.” Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None 23 - 106 - Adoption of an ordinance to decrease the appropriation to the FY 2023 Portsmouth Public Schools General Fund Budget by $696,054 at the request of PPS. Background:  City Council appropriated $181,869,545 to the FY 2023 General Fund Budget for the Portsmouth Public Schools (PPS) by Ordinance 2022-37 adopted on May 10, 2022.  At the request of PPS, by Ordinance 2022-104 adopted on November 22, 2022, City Council appropriated additional funding from the Commonwealth in the amount of $486,588 to the FY 2023 PPS General Fund Budget.  At the request of PPS, by Ordinance 2022-105 adopted on November 22, 2022 City Council re-appropriated funding in the amount of $6,611,872 that was unexpended prior to July 1, 2022 from the FY 2022 PPS General Fund Budget to the FY 2023 PPS General Fund Budget.  Upon completion of its audit to determine final figures, PPS determined that the amount of unexpended funds re-appropriated by Ordinance 2022-105 should be reduced by $696,054.  On February 23, 2023, the Portsmouth School Board adopted a Resolution requesting that City Council reduce the appropriation to the FY 2023 Portsmouth Public Schools General Fund Budget by $696,054 to reflect the final figures in the PPS audit. Discussion:  City Council Ordinance 2021-31 states “all unspent appropriations under this ordinance or any ordinance appropriating funds for the FY 2022 Portsmouth Public Schools budgets shall lapse at the end of the fiscal year, as provided under 22.1-100 of the Code of Virginia. Funds encumbered but unpaid by the end of the fiscal year will be deemed unspent appropriations that will require re-appropriations by the City Council.”  Re-appropriation Request of Unspent/Carryforward Funds: PPS previously requested the re-appropriation of $6,611,872 in unexpended funds from the FY 2022 PPS General Fund budget to the FY 2023 PPS General Fund budget, subject to confirmation of an exact amount by audit. The audit is now complete and PPS is seeking to reduce the re-appropriation by $696,054 to accurately reflect the audit.  The following table shows the impact of the proposed re-appropriation to the FY 2023 PPS General Fund: Current Additional Total Revised FY 2023 Appropriation FY 2023 Fund Appropriation Appropriation $188,968,005 (- $696,054) General Fund $188,271,951 Financial Impact  This is a reduction of a previous appropriation to the FY 2023 PPS General Fund Budget.  The appropriation to the FY 2023 PPS General Fund Budget will decrease by $696,054. Staff Recommends:  Adoption of the ordinance.
