However, <br />Suffolk Benton, LLC has offered to pay a larger amount - $5,000 – in exchange for the <br /> <br />City’s grant of the easement. <br /> <br /> The conveyance of an easement of this nature requires a public hearing. A public <br />th <br /> <br />hearing will be held at the February 28 City Council meeting. <br /> <br />Financial impact: <br /> <br />The City will receive $5,000 in exchange for the easement. <br /> <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> <br /> The City Manager will execute and deliver the proposed drainage easement. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Hugel, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE GRANT OF A PRIVATE DRAINAGE EASEMENT <br />TO SUFFOLK BENTON, LLC ENCUMBERING APPROXIMATELY FORTY-FIVE <br />HUNDREDTHS OF AN ACRE OF PROPERTY OWNED BY THE CITY OF <br />PORTSMOUTH AT 1227 HOLLAND ROAD (TAX PARCEL 34*35) IN SUFFOLK. <br /> <br />WHEREAS, <br /> the City of Portsmouth owns 1227 Holland Road in Suffolk, an <br />approximately 905-acre parcel that serves as part of the watershed protecting the City’s <br />reservoir lakes (the “Property”); and <br /> <br />WHEREAS, <br /> Suffolk Benton, LLC, the owner of an adjacent parcel, is requesting <br />that the City grant a private drainage easement encumbering approximately forty-five <br />hundredths of an acre of the Property; and <br /> <br />WHEREAS, <br /> the Department of Public Utilities manages the City’s watershed <br />properties in Suffolk and has determined that the requested easement will not have any <br />negative impact on the Property or the City’s watershed; and <br /> <br />WHEREAS, <br /> the grant of the requested easement will not impact the future value <br />of the Property, because it is the City’s intent that the Property always remain an <br />undeveloped watershed; and <br /> <br />WHEREAS, <br /> Suffolk Benton, LLC has offered to pay $5,000 to the City in <br />consideration for the easement, which is substantially more than the easement’s <br />appraised value; and <br /> <br />WHEREAS, <br /> City Council has conducted a public hearing on the proposed <br />conveyance of the easement in accordance with the requirements of the Virginia Code; <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br />by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />1. That it authorizes the grant of a private drainage easement encumbering <br />approximately forty-five hundredths of an acre of 1227 Holland Road (Tax Parcel 34*35) <br />in Suffolk to Suffolk Benton, LLC or its assigns for a price of $5,000. <br /> <br />2. That the easement shall be substantially as shown on that certain “Exhibit <br />Showing Variable Width Private Drainage Easement on Tax Parcel 34*35 for the Benefit <br />of Tax Parcel 34*66 Holy Neck Borough Suffolk, Virginia” prepared by MSA, P.C., dated <br />December 7, 2022, and attached hereto as Exhibit A. <br /> <br /> <br /> <br /> <br /> <br /> <br />
