February 14, 2023 <br /> <br />(h) Prior to initially occupying and operating the approved use and so long as the use <br />remains in operation, the owners and/or operators shall install and maintain digital video <br />equipment with recording capabilities sufficient to indicate the date and time that the <br />recording is made. The recording shall provide surveillance coverage encompassing the <br />front, side, and rear exteriors of the establishment for 24 hours a day, 7 days a week. <br />Recorded data must be maintained in a condition permitting review of the information for <br />a period of no less than thirty days. <br /> <br />(i) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Without limitation, violation of any of the <br />conditions set forth herein may serve as grounds for revocation of the use permit by City <br />Council. See Section 40.2-533(L) of the Zoning Ordinance. <br /> <br />ADOPTED <br /> by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />February 14, 2023.” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Glover <br />Nays: Whitaker <br /> <br />(c) UP-22-21 UPTOWN - Resolution granting the request of Woda Cooper <br />Companies, Inc. for a Use Permit to construct a 50-unit, four-story <br />multi-family dwelling on approximately 1.82 acres at a density of 27 <br />units per acre located at 1100, 1116, and 1130 High Street; 1121 <br />and 1125 Queen Street; 460, 462, 466, and 470 Primrose Street. <br />The properties are zoned Neighborhood Mixed-Use (NMU) and are <br />within the Innovation Overlay District. The Build One Portsmouth <br />Comprehensive Plan’s Future Land Use Map designates these <br />parcels as part of a Mixed-Use Corridor. The properties are owned <br />by Portsmouth Economic Development Authority (EDA). Planning <br />Commission recommends approval with conditions. <br /> <br />1. Bruce Watson, 530 South Main Street, Norfolk, presented the application. <br /> <br />2. Donna Biggs, 3104 Garland Drive, spoke in opposition to this item. <br /> <br />3. Ursula Murphy, 2001 Elmhurst Lane, inquired as to who would be managing the rentals <br />and if there was any preference to provide housing for the homeless population. <br /> <br />4.
