February 14, 2023 <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with the application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the approval with <br />conditions of the application for a use permit. <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it has reviewed and considered the application materials, the City staff <br />report, the proceedings and recommendation of the Planning Commission, all comments <br />made at the public hearing, and the discussion of the Council regarding the application. <br /> <br /> 2. That it has considered factors it deemed applicable and consistent with the <br />Code of Virginia, which may include, without limitation, the nature, extent, external effects, <br />location, design or method of operation of the requested use, the City’s comprehensive <br />plan, and the public health, safety, and general welfare. <br /> <br /> 3. That it has considered the imposition of conditions regarding the location, <br />character, and other features of the proposed use and finds and determines that the <br />conditions imposed by this Resolution are necessary to ensure compliance with the <br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse <br />effects from the proposed use. <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to construct and operate a 50-unit, four-story <br />multi-family dwelling at 1100, 1116 and 1130 High Street, 1121 and 1125 Queen Street, <br />and 460, 462, 466 and 470 Primrose Street (Tax Parcels 0032-1520, 0032-1530, 0032- <br />1580, 0032-1610, 0032-1590, 0032-1660 and 1670, 0032-1680, 0032-1690, and 0032- <br />1700, respectively), the said properties being more particularly described as: <br /> <br />UP-22-21 <br /> <br /> <br />1100 High Street <br />(Tax Parcel 0032-1520) <br />466 Primrose Street <br />(Tax Parcel 0032-1690) <br />470 Primrose Street <br />(Tax Parcel 0032-1700) <br /> <br />ALL THOSE certain lots, pieces or parcels of land, with the buildings and improvements <br />thereon and the appurtenances thereunto belonging, situate in the City of Portsmouth, <br />Virginia, and being bounded and described as follows, to-wit: <br />BEGINNING at the northwest intersection of Primrose Street and High Street and from <br />thence running west along High Street eighty (80) feet; thence north and parallel with <br />Primrose Street one hundred thirteen (113) feet; thence east and parallel with High Street <br />eighty (80) feet to Primrose Street; thence south along Primrose Street one hundred <br />thirteen (113) feet to the point of beginning and is composed of Lots One (1), Two (2), <br />Three (3), and Four (4) on the Plat of the Wilson property sold by L. Hermanson and John <br />Neely, duly recorded in the Clerk’s Office of the Circuit Court for the City of Chesapeake, <br />Virginia in Map Book 2, pages 30 and 31. <br /> <br />IT BEING all that certain property conveyed by Deed of Bargain and Sale from <br />Portsmouth Redevelopment and Housing Authority to Economic Development Authority <br />of the City of Portsmouth, Virginia by Deed of Bargain and Sale dated September 21, <br />2018 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number <br />180009596. <br /> <br /> <br /> <br /> <br /> <br />
