January 10, 2023 <br /> <br />Financial impact: <br /> <br /> N/A <br /> <br />Recommended Action: <br /> <br /> Adoption of the proposed resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The Resolution will be forwarded to the Judges of the Circuit Court. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“RESOLUTION CONFIRMING THAT HOLIDAYS ESTABLISHED BY THE CITY <br />MANAGER PURSUANT TO HER AUTHORITY UNDER SECTION 2-111(A)(14) OF <br />THE CITY CODE CONSTITUTE GENERAL HOLIDAYS FOR THE EMPLOYEES OF <br />THE CITY OF PORTSMOUTH. <br /> <br /> WHEREAS, <br />Section 2-111(a)(14) of the City Code authorizes the City Manager to <br />designate holidays to be observed by the City; and <br /> <br />WHEREAS, <br /> City Managers have used this authority to grant City employees an <br />extra day or half day off in advance of Thanksgiving or Christmas; and <br /> <br />WHEREAS, <br /> the Judges of the Circuit Court have generally desired to allow the <br />Circuit Court Clerk’s Office to observe the holidays declared by the City Manager, but <br />under Section 17.1-207(A)(1) of the Virginia Code they cannot do so unless the holiday <br />has been established “by a resolution duly adopted by the governing body of \[the\]…city”; <br />and <br /> <br />WHEREAS, <br /> in the past this has resulted in City Council having to adopt separate <br />resolutions affirming every holiday established by the City Manager, which is inconsistent <br />with the grant of authority in Section 2-111(a)(14); and <br /> <br /> WHEREAS, <br />it is the intent of this Resolution to affirm and establish that all future <br />days or parts thereof designated by the then-acting City Manager as holidays are general <br />holidays for the employees of the City of Portsmouth; and <br /> <br />WHEREAS, <br />it is further intended that the Judges of the Circuit Court be entitled to <br />rely on this Resolution to satisfy the requirements of Section 17.1-207(A)(1) for <br />authorizing the closure of the Circuit Court Clerk’s Office on all such future days or parts <br />thereof; and <br /> <br /> WHEREAS, <br />in addition and without limitation, the City Manager’s establishment of <br />Friday, December 23, 2022 as a general holiday for the employees of the City of <br />Portsmouth is hereby ratified and confirmed; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that all future days or parts thereof designated by the then-acting City Manager <br />as holidays in accordance with her authority under Section 2-111(a)(14) of the City Code <br />are hereby declared to constitute general holidays for the employees of the City of <br />Portsmouth.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
