Next Steps Following Council Action:  The Resolution will be forwarded to the Judges of the Circuit Court. Motion by Ms. Lucas-Burke, and seconded by Mr. Moody, to adopt the following ordinance, and was adopted by the following vote: “RESOLUTION CONFIRMING THAT HOLIDAYS ESTABLISHED BY THE CITY MANAGER PURSUANT TO HER AUTHORITY UNDER SECTION 2-111(A)(14) OF THE CITY CODE CONSTITUTE GENERAL HOLIDAYS FOR THE EMPLOYEES OF THE CITY OF PORTSMOUTH. WHEREAS, Section 2-111(a)(14) of the City Code authorizes the City Manager to designate holidays to be observed by the City; and WHEREAS, City Managers have used this authority to grant City employees an extra day or half day off in advance of Thanksgiving or Christmas; and WHEREAS, the Judges of the Circuit Court have generally desired to allow the Circuit Court Clerk’s Office to observe the holidays declared by the City Manager, but under Section 17.1-207(A)(1) of the Virginia Code they cannot do so unless the holiday has been established “by a resolution duly adopted by the governing body of \[the\]…city”; and WHEREAS, in the past this has resulted in City Council having to adopt separate resolutions affirming every holiday established by the City Manager, which is inconsistent with the grant of authority in Section 2-111(a)(14); and WHEREAS, it is the intent of this Resolution to affirm and establish that all future days or parts thereof designated by the then-acting City Manager as holidays are general holidays for the employees of the City of Portsmouth; and WHEREAS, it is further intended that the Judges of the Circuit Court be entitled to rely on this Resolution to satisfy the requirements of Section 17.1-207(A)(1) for authorizing the closure of the Circuit Court Clerk’s Office on all such future days or parts thereof; and WHEREAS, in addition and without limitation, the City Manager’s establishment of Friday, December 23, 2022 as a general holiday for the employees of the City of Portsmouth is hereby ratified and confirmed; NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that all future days or parts thereof designated by the then-acting City Manager as holidays in accordance with her authority under Section 2-111(a)(14) of the City Code are hereby declared to constitute general holidays for the employees of the City of Portsmouth.” Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None
