Merle Rutledge, 1415 Jackson Avenue, Chesapeake, voiced his concern with the use <br /> of the term “low rent” by a councilmember. <br /> <br />Motion by Dr. Whitaker, and seconded by Mr. Battle, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ZONING AMENDMENT ORDINANCE Z-22-05.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />(b) UP-22-15 TOWNE POINT PLAZA - Resolution granting the request of John <br />Sandow, PE, on behalf of The Flats at Twin Pines, LLC, for a Use <br />Permit for a four-story, 82-unit senior living multi-family dwelling on <br />the approximately 3.73-acre property at 3993 Twin Pines Road with <br />a proposed density of 22 dwelling units per acre. The property is <br />currently zoned Conditional Multi-Family Urban Residential (UR-M- <br />K). The applicant is concurrently requesting a Rezoning of the <br />property to remove the existing proffers (Z-22-05). The Future Land <br />Use Map of the Build One Portsmouth Comprehensive Plan <br />designates this property for Multi-Family Residential. The property <br />is owned by The Flats at Twin Pines, LLC. Planning Commission <br />recommend approval with conditions. <br /> <br />1. Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item. <br /> <br />Motion by Dr. Whitaker, and seconded by Mr. Battle, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-22-15) TO THE FLATS AT TWIN <br />PINES, LLC TO CONSTRUCT AND OPERATE A FOUR-STORY SENIOR LIVING <br />MULTI-FAMILY DWELLING HAVING NOT MORE THAN EIGHTY-TWO RESIDENTIAL <br />UNITS LOCATED AT 3993 TWIN PINES ROAD (TAX PARCEL 0846-0028). <br /> <br /> <br />WHEREAS <br /> , John Sandow, on behalf of The Flats at Twin Pines, LLC, the owner <br />of the subject property, has made application pursuant to Section 40.2-533 of the Code <br />of the City of Portsmouth, Virginia for the granting of a use permit to construct and operate <br />a four-story senior living multi-family dwelling having not more than eighty-two residential <br />units and located at 3993 Twin Pines Road (Tax Parcel 0846-0028); and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the approval with <br />conditions of the application for a use permit. <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it has reviewed and considered the application materials, the City staff <br />report, the proceedings and recommendation of the Planning Commission, all comments <br />made at the public hearing, and the discussion of the Council regarding the application. <br /> <br /> 2. That it has considered factors it deemed applicable and consistent with the <br />Code of Virginia, which may include, without limitation, the nature, extent, external effects, <br />location, design or method of operation of the requested use, the City’s comprehensive <br />plan, and the public health, safety, and general welfare. <br /> <br /> <br /> <br /> <br /> <br />
