November 22, 2022 (d) Without limitation, prior to initially operating the event space/banquet hall, a Zoning Permit must be obtained from the Zoning Administrator and a Certificate of Occupancy (CO) must be obtained from the Department of Permits and Inspections. (e) The maximum occupancy load of the event space/banquet hall, including patrons and employees, shall be in compliance with any limits set by the Building Official. (f) All local, state, and federal licenses and permits required for operation of the establishment shall be obtained and maintained in good standing. (g) All taxes/fees associated with the property and/or the proposed use must be paid when due, as determined by the City Treasurer. (h) The owners and/or operators of the establishment shall not violate any laws of the Commonwealth or ordinances of the City related to peace and good order, nor suffer repeated or chronic violations by any patrons or customers. If the Chief of Police, in their discretion, determines that there are significant violations of this type so as to comprise a significant law enforcement problem, they may notify the applicant in writing and provide a copy of such notice to the Zoning Administrator, which may result in the initiation of proceedings for the revocation of this Use Permit. This clause is not to be construed as a limitation or waiver of any other grounds for revocation of this Use Permit under the Zoning Ordinance or the terms hereof. REVOCATION OF PERMIT: 7. Violation of any of the conditions set forth herein may serve as grounds for revocation of the use permit by City Council.” Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover Nays: None - City Manager’s Report - 22 - 336 - Adoption of an ordinance accepting an allocation of $42,432 from the State Compensation Board Technology Trust Fund and appropriating said amount in the FY 2023 Grants Fund for use by the Portsmouth Circuit Court Clerk’s Office to fund technology maintenance and improvements. Background:  The Technology Trust Fund is allocated to the Clerk of Circuit Court to assist in paying for records management systems/indexing systems and hardware/software maintenance costs.  It is also utilized to pay for maintenance fees associated with the secure remote access to the land records and court records. The primary vendors are the Supreme Court of Virginia and Logan Systems Incorporated. Discussion:  The Clerk of Circuit Court has agreed to all of the services and reports required by this grant. Financial impact:  There is no local cash match required. Recommended Action:  Adoption of the proposed ordinance. Next Steps Following Council Action:  Allocation of funds to pay vendors for service.
