August 9, 2022 <br /> <br />“RESOLUTION AGREEING TO A MASTER LEASE AGREEMENT WITH THE <br />SOUTHSIDE NETWORK AUTHORITY TO OCCUPY PORTSMOUTH’S RIGHTS-OF- <br />WAY. <br /> <br /> WHEREAS, <br />pursuant to Resolution R-19-35 adopted by City Council on November <br />12, 2019, the City of Portsmouth is a member jurisdiction of the Southside Network <br />Authority (the “SNA”), together with the Cities of Chesapeake, Norfolk, Suffolk and <br />Virginia Beach (collectively, the “Member Localities”); and <br /> <br />WHEREAS, <br /> pursuant to Resolution R-22-01 adopted by City Council on January <br />11, 2022, the City entered into a Project Participation Agreement with the other Member <br />Localities regarding the financing and construction of the SNA’s regional fiber connectivity <br />ring (the “Regional Ring”); and <br /> <br />WHEREAS, <br /> the Regional Ring’s route will go through rights-of-way belonging to <br />each of the Member Localities; and <br /> <br />WHEREAS, <br /> it is therefore necessary for the Member Localities to enter into Master <br />Lease Agreements with SNA to allow SNA to occupy their rights-of-way; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that: <br /> <br /> 1. It approves, and authorizes the City Manager to execute, a Master Lease <br />Agreement with Southside Network Authority in substantially the form attached hereto as <br />Exhibit A, with such final corrections and amendments as may be necessary and proper, <br />such necessity and propriety being conclusively evidenced by signature of the Master <br />Lease Agreement. <br /> <br /> 2. The City Manager is authorized to take such further actions and execute <br />such further instruments as are consistent with the purpose of this Resolution. <br /> <br /> <br /> 3. This Resolution shall take effect upon adoption.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />22 - 244 - Boards and Commissions <br /> <br />Vice Mayor Barnes offered the following nominations: <br /> <br />Appointments for DeAnna Valentine, Director of Social Services <br />Community Policy & Management Team <br />Community Criminal Justice Board <br />Tidewater Youth Services Commission <br /> <br />Motion by Mr. Barnes, and seconded by Dr. Whitaker, to close nominations and <br />the above nominations were adopted by the following vote: <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />22 - 245 - Items Submitted by Council Members <br /> <br /> Dr. Whitaker asked that City Manager Chapman provide a report back as to whether <br /> <br />the city is collecting data on subcontractors as recommended by the previous Disparity <br />Study. Also, to report as to the reasons why if this data is not being collected. <br /> <br /> Mr. Woodard asked for an update on the Visitor’s Center and its future use. <br /> <br /> <br /> Vice Mayor Barnes asked that City Manager Chapman look into having the City cut <br /> <br />the grass at fire stations. He also spoke on the events hosted by Dorian Finney-Smith. <br /> <br /> <br /> <br /> <br />
