July 12, 2022 <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the concept plan entitled <br />Lincoln Park Phase II Conceptual Site Plan prepared by Timmons Group dated April 22, <br />2022, except as indicated below and where modifications may be required to comply with <br />all applicable local, state, and federal codes and regulations, including as necessary to <br />obtain site plan approval. <br /> <br />(b) Subject to the approval of the City Engineer (including as to design and location), <br />a cul-de-sac or roundabout connecting to the existing Lexington Drive right of way shall <br />be developed on the subject property, and all components of said cul-de-sac or <br />roundabout shall be dedicated as public right-of-way. To accomplish any required <br />dedication of new right of way, a Minor Subdivision shall be submitted for review and <br />approval prior to Site Plan approval. <br /> <br />(c) The development shall be in substantial compliance with the rendered concept <br />elevations entitled Lincoln Park Phase II Elevations prepared by Corwil Architects Inc. <br />dated February 18, 2021, except where modifications may be required to comply with all <br />applicable local, state, and federal codes and regulations, including as necessary to <br />obtain site plan approval. <br /> <br />(d) Prior to initially operating the multi-family development, and for so long as the <br />development remains in operation, the owners and/or operators of the development shall <br />install and maintain digital video equipment with recording capabilities sufficient to <br />indicate the date and time that the recording is made. The recording shall provide <br />surveillance coverage encompassing the front, side, and rear exteriors of the <br />development at all times. Recorded data must be maintained in a condition permitting <br />review of the information for a period of no less than thirty days. <br /> <br />(e) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained prior to construction and maintained in effect <br />during the operation of the development. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />22 - 210 - Adoption of an ordinance accepting a Shelter Plus Care Grant in the <br />amount of $569,041 from the Department of Housing and Urban Development and <br />appropriating said funds in the FY 2023 Grants Fund for use by the Department of <br />Behavioral Healthcare Services to provide supportive services to chronically <br />homeless and at-risk Portsmouth residents. <br /> <br />Background: <br /> <br /> Shelter Plus Care funds are allocated to assist with housing and supportive <br />services for individuals and families who are chronically homeless as defined by the U.S. <br />Department of Housing and Urban Development (HUD). <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
