June 14, 2022 <br /> <br />(f) Any maximum occupancy load limits set by the Building Official, including patrons <br />and employees, shall be strictly complied with in the operation of the event space/banquet <br />hall establishment. <br /> <br />(g) All local, state, and federal licenses and permits required for operation of the <br />establishment shall be obtained and maintained in good standing. <br /> <br />(h) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />(i) The owners and/or operators of the establishment shall not violate any laws of the <br />Commonwealth or ordinances of the City related to peace and good order, nor suffer <br />repeated or chronic violations by any patrons or customers. If the Chief of Police, in their <br />discretion, determines that there are significant violations of this type so as to comprise a <br />significant law enforcement problem, they may notify the applicant in writing and provide <br />a copy of such notice to the Zoning Administrator, which may result in the initiation of <br />proceedings for the revocation of this Use Permit. This clause is not to be construed as <br />a limitation or waiver of any other grounds for revocation of this Use Permit under the <br />Zoning Ordinance or the terms hereof. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />(c) Z-22-01 UPTOWN - Ordinance granting the request of Green Re-Leaf LLC <br />to rezone an approximately 1.45-acre property located at 1300 <br />High Street from Neighborhood Mixed-Use (NMU) to Conditional <br />Industrial (IN-K) in order to utilize the property and existing building <br />as an urban agriculture and manufacturing facility to grow and <br />cultivate industrial hemp and to produce industrial hemp extract <br />and CBD oil. The Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan designates this property for <br />Commercial use. The property is owned by Cars 4 Less, Inc. <br />Planning Commission recommends denial. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to accept the applicant’s <br />letter of withdrawal, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />22 - 157 - Adoption of a resolution to acquire 320 Quebec Street (Tax Parcel 0094- <br />0910). Deferred from the May 24, 2022, City Council meeting. <br /> <br />Background: <br /> <br /> Several years ago, City-affiliated entities, including PPIC and PRHA, acquired a <br />number of properties in the Sugar Hill section of Portsmouth. PRHA acquired 320 Quebec <br />Street at tax sale in 2005. <br /> <br /> While the acquisitions were originally made with an eye toward potential <br />development of the area, it was ultimately determined by the City that development was <br />not desirable because the Sugar Hill area is too low-lying and has too many flooding <br />concerns. <br /> <br /> At the request of City Council in 2013, PPIC conveyed all of its property in Sugar <br /> <br />Hill to the City. <br /> <br /> The 320 Quebec Street property has a home on it, and until recently PRHA leased <br /> <br />the home for residential occupancy. <br /> <br /> <br /> <br /> <br /> <br />
