February 8, 2022 <br /> <br />(f) The dumpster area must comply with all relevant state and local codes (including <br />without limitation Portsmouth City Code Section 40.2-304(F)(5)), including complying with <br />surfacing, setback, and screening requirements. <br /> <br />(g) The owners and/or operators of the establishment shall not violate any laws of the <br />Commonwealth or ordinances of the City related to peace and good order, nor suffer <br />repeated or chronic violations by any patrons or customers. If the Chief of Police, in their <br />discretion, determines that there are significant violations of this type so as to comprise a <br />significant law enforcement problem, they may notify the applicant in writing and provide <br />a copy of such notice to the Zoning Administrator, which may result in the initiation of <br />proceedings for the revocation of this Use Permit. This clause is not to be construed as <br />a limitation or waiver of any other grounds for revocation of this Use Permit under the <br />Zoning Ordinance or the terms hereof. <br /> <br />(h) The proposed development shall be developed and maintained in compliance with <br />all applicable codes, ordinances and regulations of federal, state and local government, <br />and all required licenses and permits shall be obtained and remain in effect at all times <br />during its operation. <br /> <br />(i) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />22 - 36 - Adoption of an ordinance accepting a Circuit Court Records Preservation <br />Program grant in the amount $46,069.52 from the Library of Virginia and <br />appropriating said funds in the FY 2022 Grants Fund for use by the Circuit Court <br />Clerk’s Office. <br /> <br />Background: <br /> <br /> The Library of Virginia Circuit Court Records Preservation Program (CCRP) is a <br />collaborative program between the Library of Virginia and the Virginia Court Clerks <br />Association (VCCA). <br /> <br /> The CCRP provides resources to help preserve and make accessible permanent <br />circuit court records stored in the 120 circuit courts and at the Library of Virginia. <br /> <br /> This year the program awarded $4.7 million to 101 localities to assist clerks’ offices <br />with their preservation efforts. It is funded through a $3.50 portion of the clerk’s <br />recordation fee. <br /> <br />Discussion: <br /> <br /> The Clerk of Circuit Court has agreed to all the services and reports required by <br />this grant. <br /> <br />Financial impact: <br /> <br /> No local cash match is required as a condition of the grant. <br /> <br />Recommended Action: <br /> <br /> Adoption of the proposed ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The Finance Department will make the necessary budget adjustments. <br /> <br /> The Clerk of Circuit Court will continue with record preservation activities. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Woodard, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br /> <br /> <br /> <br />
