"Suffolk's City Manager John L. Rowe, has requested conveyance of a sewer easement across Portsmouth's Lake Speight Run Watershed. Suffolk's installation of sewers in this area would alleviate a documented, long-standing septic tank overflow problem from their Oakridge area into Portsmouth's reservoirs. Portsmouth Utility Director Jim Spacek, has reviewed the proposed easements alignment and sewer design. He advises that the easement would cross what is essentially the high edge of a ravine and wou~d not impact the existing buffer and soil filter around the Lake Speight Run reservoir. Mr. Spacek also indicated that the sewer design appears adequate. Mr. Spacek recommends that this easement be conveyed to Suffolk conditioned to their agreeing to pay any survey and recording costs, along with their inclusion of sedimentation, erosion control and restoration measures in the construction documents. The City Attorney has drafted the attached resolution authorizing me to execute an agree- ment for the conveyance of the easement. I concur with staff's recommendation." Vote:· ~ !i ~ "A RESOLUTION AUTHORZING THE CITY MANAGER TO ENTER INTO AN EASEMENT AGREEMENT WITH THE CITY OF SUFFOLK FOR INSTALLATION OF A SANITARY SEWER. WHEREAS, the City of Portsmouth owns certain real property located in the Oak Ridge area of the City of Suffolk; and I/~HEREAS, the City of Suffolk is installing sanitary sewer facilities in this area, and ha requested an easement for such purposes on the property of the City of Portsmouth; and WHEREAS%~ the installation o'f~sanitary sewers wouIR~duce the problems of malfunctioning septic tanks and drainage into the Lake Speight watershed; and ~EREAS, the City of Suffolk will install the sewer in accordance with acceptable stan- dards for sedimentation and erosion control as required by lawi~and will pay the cost of sur- veying and engineering for said construction, by the Council of the City of Portsmouth, Virginia, that authorized to enter into an Easement A~reement with the a sanitary sewer over, under and across the following NOW], THEREFORE, the City Manager be, City of Sdffolk for described property, BE IT RESOLVED', and hereby is, installation of to-wit:
