The Code also assesses an annual
parking fee of $100 for the privilege of using taxi stands located on public streets. ~he
Chief of Police, with the suppcrt of representatives from the taxi cab companies, has recom-
mended an ordinance which would provide that parking fees all come due on the same date as
the certificates of public convenience and necessity.

Attached is an ordinance authorizing the described change. This change would simplify
procedures for cab owners as well as facilitating the City's administrative regulation of
taxicabs. The Chief of Police has recommended that these regulations be promulgated
in order to clarify and simplify his enforcement responsibilities. The City Attorney has
reviewed the proposed policy and has determined it to be consistent with the City Code. In
addition, taxicab owners in Portsmouth have reviewed the policy and have not voted any objec-
tions.

I concur with the recommendation of the Chief of Police, and unless I receive objection
from Council Members, I intend to begin enforcing the policy on May 1, 1986. The amendment to ~23-66 provides an additional factual definition
of reckless driving, and the amendment to [23-305 clarifies that the striking of property
other than another vehicle with minor damage is a traffic infraction and not a Class 1 misde-
meanor.

The City Attorney is of the opinion that the changes are permitted, but not mandated,
by State law. The Chief of Police recommends their adoption, and I concur in same."
