<br /> The 1985-90 Capital Improvement Program authorizes $72,)00 for this project. Previously,
<br />$54,000 was appropriated for the project leaving a balance of $18,000 that is now being re-
<br />quested. The total contract time of 45 days will be extended by approximately one month.
<br />
<br /> I concur with the Director of Public Works, and recommend that the approval to exceed the
<br />25% change order limit be granted and that the available $18,000 be appropriated."

<br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following ordinance was approved on
<br />first reading, and was adopted by unanimous vote:

<br /> "The City Code requires taxicab owners to obtain a certificate of public convenience and
<br />necessity in order to operate within the City of Portsmouth. The Code also assesses an annual
<br />parking fee of $100 for the privilege of using taxi stands located on public streets. ~he
<br />Chief of Police, with the suppcrt of representatives from the taxi cab companies, has recom-
<br />mended an ordinance which would provide that parking fees all come due on the same date as
<br />the certificates of public convenience and necessity.

<br /> Attached is an ordinance authorizing the described change. This change would simplify
<br />procedures for cab owners as well as facilitating the City's administrative regulation of
<br />taxicabs. I therefo're recommend that you adopt it as presented.
<br />
<br /> On a related matter, the City Code establishes operational requirements for taxicab owner
<br />and is intended to ensure the availability of clean and safe taxicab service to our citizens.
<br />the attached administrative policy establishes additional rules and regulations as authorized
<br />by Section 37-42. The Chief of Police has recommended that these regulations be promulgated
<br />in order to clarify and simplify his enforcement responsibilities. The City Attorney has
<br />reviewed the proposed policy and has determined it to be consistent with the City Code. In
<br />addition, taxicab owners in Portsmouth have reviewed the policy and have not voted any objec-
<br />tions.
<br />
<br /> I concur with the recommendation of the Chief of Police, and unless I receive objection
<br />from Council Members, I intend to begin enforcing the policy on May 1, 1986. If you have any
<br />questions, please give me a call."

<br />change.

<br /> On motion of Mrs. Lucas and seconded by Mrs. Webb, the following ordinance was adopted on
<br />first and final reading, and by the following vote:

<br />"AN ORDINANCE TO AMEND CHAPTER 37 OF THE CODE OF THE CITY OF PORTSMOUTH, 1975, AS
<br />MqENDED; BYiA~ENDING SECTION 37-29 THEREOF PERTAINING TO TAXICAB PARKING PRIVILEGE
<br />FEES."

<br /> 86-85 - Letter from the City Manager recommending adopgion of an ordinance to amend
<br />Sections 23-66 and 23-305 pertaining to motor vehicles.
<br />
<br /> "At the request of the Judges of the General District Court and the Portsmouth Police
<br />Department, the City Attorney has prepared an ordinance amending the City Code sections per-
<br />taining to motor vehicles. The amendment to ~23-66 provides an additional factual definition
<br />of reckless driving, and the amendment to [23-305 clarifies that the striking of property
<br />other than another vehicle with minor damage is a traffic infraction and not a Class 1 misde-
<br />meanor.
<br />
<br /> The City Attorney is of the opinion that the changes are permitted, but not mandated,
<br />by State law. The Chief of Police recommends their adoption, and I concur in same."
