<br /> 86-107 Letter from the City Manager recommending adoption of an ordinance to amend
<br />the Code of the City of Portsmouth, Virginia, 1973, by amending Section 24-86 thereof, per-
<br />taining ~o pessession and consumption of alcoholic beverages, etc., in any City Park, etc.
<br />
<br /> "At the request of the Police Department, the City Attorney has reviewed the penalty
<br />provisions of that portion of the City Code controlling possession and consumption of alcohol
<br />beverages, drugs, controlled substances, or any o~hem intoxicating substance in any part of
<br />any city park, recreation, or playground area. In order to clarify same, it is the suggestio:
<br />of the City Attorney that the penalty provision therein be revised to clearly establish that
<br />the possession or consumption of alcoholic beverages without appropriate authority as well
<br />as being under the influence of alcoholic beverages, drugs, controlled substances or other
<br />intoxicating substances is punishable as a Class 4 misdemeanor. The authorized punishment
<br />for conviction of a Class 4 misdemeanor is a fine of not more than $100.00
<br />
<br /> The City Attorney also advises that such clarification does not change the current
<br />penalty but merely states same in the controlling section as opposed ~o relying on a referenc
<br />to the Miscellaneous Offenses chapter of the City Code. Violations of drug related offenses
<br />which occur within the parks will remain controlled by the Control Drugs Ordinance contained
<br />in ARticle II of Chapter 21 of the City Code.

<br /> I concur with the recommendation of the ~Chief of Police and request that Council approve
<br />this amendment to clarify the penalty for violation of the section."

<br />City Treasurer's iist of Delinquent Personal Property Taxes for the taxable year 1985.

<br />mitting to City Council a list of Delinquent Personal Property Taxes for the taxable year 198!

<br /> Also enclosed is a report showing statistical data related to personal property taxes
<br />for the past five years, which was prepared in the Department of Finance.
