April 8, 1986 <br /> <br /> On mo~ion of Mrs. Lucas and seconded by Mr. Corprew, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 21 OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY ADDING <br />THERETO SECTION 21-98.1, PERTAINING TO POLICE ANIMALS.' <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 86-107 Letter from the City Manager recommending adoption of an ordinance to amend <br />the Code of the City of Portsmouth, Virginia, 1973, by amending Section 24-86 thereof, per- <br />taining ~o pessession and consumption of alcoholic beverages, etc., in any City Park, etc. <br /> <br /> "At the request of the Police Department, the City Attorney has reviewed the penalty <br />provisions of that portion of the City Code controlling possession and consumption of alcohol <br />beverages, drugs, controlled substances, or any o~hem intoxicating substance in any part of <br />any city park, recreation, or playground area. In order to clarify same, it is the suggestio: <br />of the City Attorney that the penalty provision therein be revised to clearly establish that <br />the possession or consumption of alcoholic beverages without appropriate authority as well <br />as being under the influence of alcoholic beverages, drugs, controlled substances or other <br />intoxicating substances is punishable as a Class 4 misdemeanor. The authorized punishment <br />for conviction of a Class 4 misdemeanor is a fine of not more than $100.00 <br /> <br /> The City Attorney also advises that such clarification does not change the current <br />penalty but merely states same in the controlling section as opposed ~o relying on a referenc <br />to the Miscellaneous Offenses chapter of the City Code. Violations of drug related offenses <br />which occur within the parks will remain controlled by the Control Drugs Ordinance contained <br />in ARticle II of Chapter 21 of the City Code. <br /> <br /> I concur with the recommendation of the ~Chief of Police and request that Council approve <br />this amendment to clarify the penalty for violation of the section." <br /> <br /> On motion o~ Mr. Gray and seconded by Mrs. Webb, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE ro AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMEND <br />ING SECTION 24-86 THEREOF, PERTAINING TO POSSESSION AND CONSUMPTION OF ALCOHOLIC <br />BEVERAGES, ETC. IN ANY CITY PART, ECT." <br /> <br />Ayes.: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 86-108 Letter from the City Manager recommending adoption <br />$1,080.54 (without interest) to John Francis Regan, t/a Downtown <br />i985 Business License. <br /> <br />of a motion to refund <br />Exxon, for unused portion of <br /> <br /> "~he Commissioner of Revenue is requesting a refund of $1,080.54 to John Francis Regan, <br />t/a Downtown Exxon, ~00 Court Street, Portsmouth, Virginia 23704. <br /> <br /> The business closed on October 8, 1985; thus a refund is due for the unused pcrtmon of <br />their 1985 Business License. <br /> <br />I recommend that Council adopt this mozion, and a refund be granted." <br /> <br /> Motion of Mr. Beamer and seconded by Mrs. Lucas, that authorization be granted to refund <br />John Francis Regan, t/a Downtown Exxon, 4705 Wellingboraugh Reach, Virginia Beach, VA 23455, <br />$1,080.54 (without interest) for unused portion of 1985 Business License, and was adopted by <br />unanimous vo~e. <br /> <br /> 86-109 Letter from the City Manager recommending adoption of a motion transmitting the <br />City Treasurer's iist of Delinquent Personal Property Taxes for the taxable year 1985. <br /> <br /> 'Transmitted herewith is a letter from Mr. Charles B. Whitehurst, City Treasurer, sub- <br />mitting to City Council a list of Delinquent Personal Property Taxes for the taxable year 198! <br /> <br /> Also enclosed is a report showing statistical data related to personal property taxes <br />for the past five years, which was prepared in the Department of Finance. <br /> <br /> A copy of the printout listing Delinquent 1985 Personal Property Taxes is available in <br />the City Clerk's Office for Council's use.
