October 12, 2021 <br /> <br />(a) The billboard shall be in substantial compliance with the site location survey <br />entitled “A Billboard Located on Tax Parcel 0809-0100, 5720 High Street West” prepared <br />by DKT Associates dated 12/8/2015 and structural plans prepared by TES dated 7/8/2019 <br />except where modifications may be required to comply with all applicable local, state, and <br />federal codes and regulations. <br /> <br />(b) The billboard shall be landscaped at the base of the structure. <br /> <br />(c) The billboard shall be in compliance with applicable codes, ordinances and <br />regulations of federal, state, and local government, and all required licenses and permits <br />shall be obtained and kept in good standing. <br /> <br />(d) The billboard shall be maintained in good condition and in compliance with the <br />requirements of the Zoning Ordinance at all times. <br /> <br />(e) All pole mounted signs that face a public street and are no longer in use shall be <br />removed from the property. New signage will be permitted to be installed in accordance <br />with the provisions of the Zoning Ordinance. <br /> <br />(f) All taxes/fees associated with the property shall be paid when due, as determined <br />by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br /> <br />(d) CA-21-03 CITYWIDE- Ordinance granting the request of the City of <br />Portsmouth to amend City Code Ch. 40.2 Zoning Ordinance to <br />exempt existing structures in the Downtown (D1) district from the <br />minimum required density; to amend the maximum permitted <br />height for new construction in HR, HLO, and HLB; to add the event <br />space/banquet hall use; to remove the garage sales/residential <br />sales accessory use; to amend the use designation of several uses <br />in the Use Table; to amend Table 40.2-304(2) Buffer Type <br />Application of the landscaping sub-section; to exempt townhouse <br />residential development from the open space set-aside <br />requirement; to allow ground signs in the UR and UR-M zoning <br />districts; to remove the common ownership subdivision <br />requirement in the nonconformities sub-section; and to correct <br />scrivener’s errors throughout Zoning Ordinance. Planning <br />Commission recommends approval with conditions. <br /> <br />1. Bob Baldwin, Deputy City Manager, presented the application. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND CHAPTER 40.2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) PERTAINING TO ZONING FOR THE PURPOSE OF <br />ADDRESSING VARIOUS DENSITY, HEIGHT, USE, LANDSCAPING, OPEN SPACE, <br />AND SIGNAGE REQUIREMENTS, AND TO CORRECT SCRIVENER’S ERRORS.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
