September 28, 2021 Background:  City Council appropriated $21,423,000 to the FY 2022 Risk Management Fund for the Portsmouth Public Schools (PPS) on May 11, 2021.  On September 2, 2021 the Portsmouth School Board adopted a Resolution requesting that City Council appropriate the preliminary amount totaling $1,544,748 from the FY 2021 PPS Risk Management Fund Budget to the FY 2022 PPS Risk Management Fund Budget. Discussion:  City Council Ordinance 2020-38 states “all unspent appropriations under this ordinance or any ordinance appropriating funds for the FY 2021 Portsmouth Public Schools budgets shall lapse at the end of the fiscal year, as provided under 22.1-100 of the Code of Virginia. Funds encumbered but unpaid by the end of the fiscal year will be deemed unspent appropriations that will require re-appropriations by the City Council.”  Re-appropriation Request of Unspent/Carryforward Funds: PPS is requesting the re-appropriation of the preliminary amount of $1,544,748 related to unspent funds as of the end of the fiscal year. The unspent funds would be used for the following: $302,358 for the Workers’ Compensation/General Liability Program o $1,242,390 for the PPS Health Plan o  The following table shows the impact of the proposed re-appropriation of the preliminary amount to the FY 2022 PPS Risk Management Fund: Current Total Revised FY 2022 FY 2021 Re-FY 2022 Fund Appropriation appropriation Appropriation $21,423,000 Risk Management Fund $1,544,748 $22,967,748 Financial Impact:  This is a re-allocation of previously appropriated FY 2021 PPS Risk Management Fund money.  The FY 2022 PPS Risk Management Fund will increase by the amount shown above. Staff Recommends:  Adoption of the ordinance. Next Steps Following Council Action:  The Finance Departments for the City and Schools will complete the necessary budget adjustments. 1. Donna Sayegh, 3104 Garland Drive, voiced her concern with the re-appropriation of funds. Motion by Ms. Lucas-Burke, and seconded by Dr. Whitaker, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE TO RE-APPROPRIATE UNEXPENDED FUNDS IN THE AMOUNT OF $1,544,748 FROM THE FY 2021 PORTSMOUTH PUBLIC SCHOOLS RISK MANAGEMENT FUND BUDGET TO THE FY 2022 PORTSMOUTH PUBLIC SCHOOLS RISK MANAGEMENT FUND BUDGET.” Ayes: Battle, Lucas-Burke, Moody, Whitaker, Woodard, Barnes Nays: None 21 - 292 - Adoption of a resolution certifying the City of Portsmouth’s support of an application for a Virginia Department of Housing and Community Development Port Host Communities Grant in the amount of $1,000,000 in furtherance of the revitalization of 3301 Shipwright Street for port-related uses.
