April 22~ 1986 <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />AMENDING SECTIONS 23-73(a) AND 32-16 THEREOF, PERTAINING TO RIDING ON THE <br />SIDEWALKS." <br /> <br />BY <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 86-119 Letter from the City Manager recommending adoption of a resolution authorizing <br />the conveyance of property on Portsmouth's Lake Speights Run watershed to the ~ity of Suffolk. <br /> <br /> "Due to the close proximity of three wells to their original Oakridge sewage pumping <br />station size, the City Manager of Suffolk has requested the conveyance of an additional piece <br />of PortsmouthTs:.Lake Speights Run watershed property (see attached letter]. <br /> <br /> Portsmouth's Public Utilities Director, Jim Spacek, endorses this conveyance as construc- <br />tion of sewers in this area will end the overflow of sewage from malfunctioning septic tanks <br />in the Lake Speights Run Reservoir. <br /> <br /> This additional conveyance would be subject to Suffolk's pa~ing the currence appraised <br />price for the property and their implementation of proper erosion and sedimentation measures <br />during construction." <br /> <br /> On motion of Mr. Beamer and seconded by Mr. Corprew, the following resolution was adopted <br />and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CERTAIN REAL PROPERTY TO THF <br />CITY OF SUFFOLK. <br /> <br /> WHEREAS, the City of Portsmouth owns certain real property <br />which property is no longer required for public utility purposes <br />excess property; and <br /> <br />located in the City of Suffolk <br />and is, hereby, declared to b <br /> <br /> WHEREAS, the City of Suffolk desires to acquire a portion of said property in order to <br />construct a sewage pumping station; and <br /> <br /> WHEREAS, the City of Suffolk has agreed to pay the independently appraised value of said <br />parcel in the amount of $S00.00; and <br /> <br /> WHEREAS, Section 2.09(c) of the Charter of the <br />may convey property to the Commonwealth of Virginia <br />advertisement and receipt of bids; and <br /> <br />City of Portsmouth provides that the City <br />or a political subdivision thereof without <br /> <br />WHEREAS, the City of Suffolk is a political subdivision of the Commonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to convey to the City of Suffolk, upon <br />receipt of the payment of the appraised value, the following described property, to-wit: <br /> <br /> All that certain piece or parcel of land, situate, lying and being in the <br />City of Suffolk, Virginia, bounded and described as follows: beginning at a <br />point on the southern boundary of Faulk Road, said point being the point of <br />intersection of the southern boundary of Faulk Road and the boundary of Lots 8 <br />and ~ asi_shown on that certain plat entitled :Plat of Pinaire Subdivision" recorded <br />in the Clerk's Office of the Circuit Court of the City of Suffolk (formerly <br />Nansemond County) in Deed Book 9, page 3L; thence continuing along the southern <br />bo_undazy~ of Faulk Road along a curve to the left for a distance of 32.33' to the <br />TRUE POINT OF BEGINNING; thence continuing along the boundary of Faulk Road from <br />the TRUE POINT OF BEGINNING along a curve to the left having a radious of S0', <br />an arc distance of 59.63' to a point; thence south 35° 29' 20" east 120.28' to a <br />point; thence north 82° 30' 00" west 101.39' to a Foint; thence north 29° 00' east <br />34.11' to the TRUE POINT OF BEGINNING.' <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 86-120 Letter from the City Manager recommending adoption of a resolution appointing <br />viewers for closing of a portion of Elliott Avenue and Marshall Avenue. <br /> <br /> 'Jean M. Davis has made application to close a twenty foot port,on of the r~ght-of-way <br />on either side of Elliott Avenue and a portion of Marshall Avenue. <br /> <br /> The attached resolution appoints viewers in accordance with applicable State law to vmew <br />the portions of such streets and to report to the Planning Commission if any inconvenience <br />would result in the closing of Elliott Avenue and Marshall Avenue. <br /> <br />I concur and recommend the adoption of the attached resolution." <br /> <br /> On morion of Mrs. Lucas and seconded by Mr. Gray, the following resolution was adopted, <br />and by the following vote: <br /> <br /> <br />
