June 22, 2021 <br /> <br /> <br /> The Rules of Order and Procedure of the Portsmouth City Council incorporate the <br />requirements of the current version of Section 2-29. <br /> <br />Discussion: <br /> <br /> If City Council approves the Code amendment, then it is also necessary to amend <br />the Rules of Order and Procedure to conform to the new version of Section 2-29. <br /> <br />Financial Impact: <br /> <br /> N/A <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The change to a single reading for zoning approvals will be implemented on future <br /> <br />Council agendas. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Barnes, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION TO AMEND THE RULES OF ORDER AND PROCEDURE OF THE <br />PORTSMOUTH CITY COUNCIL FOR THE PURPOSE OF CONFORMING THE RULES <br />TO AMENDED SECTION 2-29 OF THE CITY CODE. <br /> <br />WHEREAS <br /> , by Ordinances adopted on the date hereof, City Council amended <br />Sections 2-29, 40.2-532(G) and 40.2-533(G) of the Code of the City of Portsmouth (2006) <br />for the purpose of allowing the approval of zoning applications without a second reading; <br />and <br /> <br />WHEREAS, <br /> the current Rules of Order and Procedure of the Portsmouth City <br />Council incorporate the requirements of the prior version of Section 2-29 of the City Code; <br />and <br /> <br />WHEREAS, <br /> it is therefore necessary to amend the Rules to conform to the <br />amendments to Section 2-29, and to make certain additional minor corrections to citations <br />to the amended and restated zoning ordinance adopted on December 8, 2020; <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia, that the Rules of Order and Procedure of the Portsmouth City Council are <br /> <br />amended as shown on Exhibit A hereto.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />21 - 189 - Adoption of a resolution authorizing the continued leasing of former <br />railroad right-of-way located in Suffolk to the City of Suffolk for use as a <br />recreational trail. <br /> <br />Background: <br /> <br /> The City of Portsmouth owns former railroad right-of-way located in Suffolk and <br />uses the right-of-way for water delivery system pipes. <br /> <br /> In 2006, the Portsmouth City Council authorized the execution of a lease with the <br />City of Suffolk to allow Suffolk to use the property for a multi-use recreational trail. <br /> <br /> The lease between Portsmouth and Suffolk had an initial term and two extension <br />terms for a total of fifteen years. The lease expires at the end of June 2021. <br /> <br /> Suffolk has requested that Portsmouth enter into a new lease with substantially the <br />same terms, including a five-year initial term and two five-year extension terms. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
